Default bombshock royalties?

since bombshock charges for its information (although i pity anyone who pays) doesn't that mean that the actaul authors of the page are entitled to royalities, or at least sign a waiver. since i know that these files are plagerised from anywhere, the authors have not signed a waiver. doesn't this lead a way for legal action against bombshock, or at least backpayments for them making a profit directly off your work? does it matter if it is not copyrighted? does a simple 'do not distribute' thing at the bottom of a text file count?

I doubt it. . .if Im not mistaken it has to be copyrighted before they can take legal action.

ive pondered this before, and never came to a real conclusion besides that theyre evil people over there, and that theyre running a total scam in more ways than one by charging people for txt files that are a) free on the rest of the internet; and b) not original work by any of the people profiting from it. but, they know how i feel, and appearantly the sentiment is mutual. so, fuck em.

A bunch of files were taken from Totse (or so I hear). And if you look at the bottom of any Totse text file there is a copyright notice. I think that in a legal battle Totse would wipe the floor with Bombcock.

The copyright notice is for the page layout and design. It says
quote:
To the best of our knowledge, the text on this page may be freely reproduced and distributed.
The site layout, page layout, and all original artwork on this site are Copyright 2002 totse.com.

.
Looks like bombshock CAN "freely reporoduce and distribute" the files.

Worst legal argument ever:

Totse could say that by "FREELY reproduced and distributed" they didn't mean anyone could copy the stuff, but they could reproduce it only if it was FREE.

Would make an amusing court case, arguing about the context of one word.

Anything you create automatically becomes copyright to YOU, unless you create it for someone who is paying you to do so (such as a corporation).

For example, a freelance journalist owns any story they write. A journalist employed by a newspaper does not, the paper does.

So no, bombshock is not operating on a legal basis. If for example, they had my "penis faq" on there, then I could ask them to remove it and be perfectly within my rights. Copyright means you have (a) the right to decide where your work ends up and (b) the right to profit from it.

Hmmm I'm creating a free website at www.geocities.com/godsstash with a text file section, but I at least keep copyrights and author's names intact and provide the appropriate links. I at least check and make sure it's all good and legal, but Jesus bombshock's just being stupid. They're SCREAMING for a lawsuit, but it might draw negative attention to totse if we do it.

After ten minutes of editing and rephrasing it would be very hard to prove anything but xplosive or whatever that little fuckwit is called wouldnt bother, I paid bombshock a visit yesterday and was pleased to see it sucked more than ever.

I say anyone who has written an article for totse check to see if it is on bombcock. If it is, we tear them a new one.

Set your monitor brightness to 25% and eat 250mg of mescaline. You will onle be able to see green letters (like textflies.com) and the background will just fade.

Both sites are infested with "kewls" and idiotic morons. Allthough totse has more forums and has also a bigger variatie of sections. I don't like the idea of being at some "underground" only forum where we only talk about doind drugs and blowing things up.

edit:
plus, here files are free, and totse just has more fame than bs. It's been here since 1989.

it was a dial-up bbs in 1989, which was shutdown in 1998, and the site popped up.

I personally think it would not be very intellegent for Totse to enter a legal battle over their text files for several reasons: 1)It would be extremely difficult, if not impossible, to prove that Totse has rights to the text files(Bombshock could say that Totse had stolen them from Bombshock, etc.) 2)I think the files would actually be copyrighted to the authors, not Totse. So, this means the authors, collectivly, would have to sue Bombshock, unless, of course, there is some statement on the submission form that says all submissions become property of Totse.

Also, some of you may have already thought about this, but it would be pretty damn funny having a legal battle over who owns the rights to a bunch of text files about illegal activites.

Is there any way to tell how many people have actually paid to get those files? It would have to be a pretty damn ignorant fucker to actually pay their fee.
