what about those people that smuggled themselves from china in a boat destined for california, since they were intercepted in Canada should they get sent back to china? stay in canada? or go to california? should we let them choose? or did they have there chance and they got caught so send 'em back when they spent there life savings on a trip to north america.

If they can prove they will be Jailed or persecuted in China then the state often allows them to stay.
