Okay, I got pulled over on some bullshit. Somehow they found a roach in the bottom of a half empty pop can with tobacco in it. I got some long drawn out speech about how I have to give them my suppliers and blah, blah, blah....

They took it and gave me a written warning for the other stuff. I was told that if I didn't get them my suppliers by Friday at noon that they'd charge me with it and fuck up my college career. That was Sunday night.

I live in the US specifically Indiana. I could give a fuck less about a month in jail, but it'd mean I'd lose everything.

I've been up and down all these legal sites and can't find anything about this. I've gotten told I can't be charged with it because it's no longer in my possession. I've also been told that they can just say they took it in for testing and still charge me with it.

Right now, I have no idea what to believe but I'm in a bit of a panic. Any insight into this would be greatly appreciated.

If it wasn't yours, and you haven't taken any illegal drugs in a while, I doubt they have a legal leg to stand on. It would be difficult enough to 'fuck up your career' on one roach, it would be easy enough to claim that it wasn't yours and you don't smoke pot anyway; the inevitable piss test could be beaten with a week or two of hard work. Also, one roach doesn't point towards you being a heroin addict, something a lawyer could quite easily convince a jury to be nothing more than 'harmless experimentation' or something. Finally, I would imagine forensically analysing a roach would be really quite expensive, maybe if you were growing, maybe if you were supplying, but its probably not worth the expenditure in the eyes of the law to get a stoner a slap on the wrist.

But of course, you don't have a dealer and that was the first time you'd ever used pot and you happened to find the joint lying on the street. I am, of course, not a lawyer, and you should therefore probably disregard everything I've said and speak to one. At least as many law students as you can find if you're in college currently.

If you have a fast metabolism, buy a piss test, and work hard, drink lots and try to flush your system through. Test yourself and see if you can pass a piss test, and then volunteer to get yourself tested; if you could pass a drug test infront of them, the charges, I imagine would be dropped.

Don't speak to another police officer without a lawyer present. If the police come to your house, tell them that. Many cops just want to score an easy bust on dumb druggies by threatening them with charges. If they can get you to rat out dealers when you haven't even done anything wrong, then you've just become a free informant for them, and made their job a hell of a lot easier.

Instead of playing into their hand, make them play yours. Get a lawyer, and have the lawyer around if the cops want to scare you with more phony charges. You cannot be arrested for having a tobacco joint.

The police probably have NO case against you. But, if they actually have this one little roach saved as evidence, they don't need to do forensic testing on it to prove that it is a roach and it was in your car. They only need to field test it, the same way they swab pipes for resin.

Ok this confuses me, did they find a hand-rolled tobacco cigarette roach in the can, or did they find a cannabis roach in the can with tobacco in the can as well? If it's the former they have got absolutely nothing on you at all. If it's the latter you could be charged with a simple possession charge(though if they were going to I imagine you would already be charged and have a court date). Either way giving up your supplier isn't going to do fuck all for you, if they are going to they will still charge your ass(not to mention the possible retaliation from your supplier). Get a lawyer now! Do not rat!
