Sadly the U.S. has never recognized the ICC and has stated that if any American politician is held on charges military action is authorized to ensure their release.

It's a war whether it's an officially declared one or not. "Occupation" occurs in declared wars too, it's the period after the brunt of the fighting is over, a territory has been secured by one side or the other and they're just maintaining their presence there until something else can be done. The terms occupation and war are not dichotomous.
