First just a bit more info, i know the guy who lost it but he isnt a friend. i was with a few more friends and were were waving the phone around and saying how it has $150...kinda shouting i dont know...and the guy may have had other friend on the bus...

anyway today we were prank texting the fuck out of his mum and shit the old "mum im gay" and "hey mark i just tried pot and acid i cant see anything, i prob spelt this whole message wrong" but in the end she was getting really worried and was calling 5 times every 30 seconds.

anyway we put her out of her misery by saying we found her son's phone and to stfu. she wrote back saying that cops and school will find us..i didnt care and spent his credit in a half hour.

about an hour later i get a message on my real phone from the guy's brother saying he know i got his phone and i better give it back tomorrow arvo or the cops are getting involved...i replied "what phone, i didnt take anything...please stop messaging me"

since then i heard nothing but i need to know, should i be worried? if it helps the kid had about one friend on the bus and i had about 4 so if it comes down to word against word i think we will win but there were a ton of miscellaneous witnesses which may be a problem.

should i deny everything or what?

also i cant return phone as i smashed it as it is a crappy Motorola v3 and i figured the lols was worth more than the $30 it was worth...i was thinking of sending a message to his brother with the video of it being smashed but decided not to..

If your friends where with you when making the calls and sms's, word dose go around so theres a chance you will get caught

and last of all, if non of his friends saw you, and your friends haven't told anyone how funny it was when yous "punkd" his mom, then there is little to no chance they will pinpoint you.

BUT

you sitting directly beind him on the bus (at the time and place he last had it befor loosing it) will make you a suspect, so you and your friends have to all get a same story if yous saw what happend to his phone or was anyway involved.



its not looking to good because you didnt go about it the right way.

you should have waited till you and your friends left the bus untill yous started fucking with the phone, or even better, done it all home alone, no telling anyone.

Probably best to just give it back anonymously. Then continue denying you had anything to do with it.

Also, no phone = no evidence = no charge = freedom.

Look at it from a lawyer's point of view.

First of all, I hate to break it to you all, but SWIM does nothing. The only purpose that "SWIM" is ever used is to replace the word "I". So theoretically, this is the same as replacing the word "handsome" with "good looking". Just because SWIM isn't in the dictionary doesn't mean it can't be used in the court of law.

However, it is unusual for text to be subpoeaned from sites where a jurisdiction cannot be established for the person involved (this i'm guessing). Text is, however, subpoeaned from social networking sites and the like, and since you have indicated that you come from sydney, austrailia, you may be at risk.

DO NOT SAY ANYTHING TO THE POLICE. You only have to tell them your name and address, but nothing else. Why? Because you have the right to remain silent. Remember that. If someone else confronts you, however, the best thing is to deny, deny.

Above all, dispose of the phone. Preferably in a scrunched up paper bag and in a council bin. Make sure your friends aren't saying something completely different to you, or better yet, nothing at all.

Since the phone is smashed, there's no use returning it. If the owner is absolutely convinced it is you, and is willing to take this as far as possible, you may want to just strike up a deal and pay him enough for a new phone. Its better than taking it to court.

Evaluate what I've said first, since you know your situation better than me.

Make sure your friends don't tell anyone. Make sure they will all back up your story. Get rid of the phone. Good luck

If ur worried about trouble w/the law, they dont got shit on u. just confront the kid and his bros and say with a straight face that u did not take. then explain that ur just a good innocent child who would never do such a thing.
