Torrent technology is perfectly legal. downloading and uploading via torrent network is perfectly legal, however it depends upon the content you're downloading/sharing.
There really isn't any best option to avoid getting into trouble whilst downloading copyrighted material. The only best and safe option is to avoid using the torrent network. The mpaa, riaa, bpi and many other groups are all over the torrent network. Downloading is really not the issue, it's more of the actual sharing of the content.
If you must pirate material, then you should use something like rapidshare. They offers direct downloads, maxed out transfer speeds and no forced sharing. They also have such a wide range of content on their database it's almost unbelievable. The only kicker is, you have to pay a small fee...and yes the fee actually really small and affordable. Well, you can use the free service, but it's limited to how much you can download a day. It beats crappy download speeds, whilst trying to hide yourself, whilst being forced to share the illegal content...Torrent is such an open network it really isn't worth the risk. Those groups will only jump on you like a bunch vultures that they are.
