Is this legal
Ok I had to sign a drug contract at work. You know standard testing if they think you are high at work, but they said that I couldnt take my scripted drugs at work if they interfere and they sometimes do makes me drowsy. Is it legal for a company to say I cant take my meds?

Re: Is this legal
definetly sounds like discrimination against whatever issues you have that you need the meds for. so what if it makes u drowsy tho? jus start the job and dont quit taking your meds. if they fire you, then you can think about a lawsuit if you were inclined to do so. if you can do your job effectively, it shouldnt make any difference to them

Probably. Considering if you cut off your arm while doing work 'cuz you're loaded full of benzos, they don't want to have to deal w/ a lawsuit.
Then again, I'm not a lawyer...

Re: Is this legal
if you live in an "employment at will" state then its legal as long as you sign.
they can fire you for any reason whatsoever provided it does not violate your civil rights and there is nothing you can do about it.
i dont think the right to take meds is a civil right but i may be wrong. but seriously if your operating heavy machinery and taking opiates it may be in there best intrest to stop you. some people can do everything fine on high doses of meds while some will take 1 pill and be stumbling around fucked.

Re: Is this legal
I was at a plastics plant where it said if you were on "certain meds" you needed a "Fit For Duty" slip, which was something you got from your doctor. Say you're on Xanax; you'd basically go to your doctor, explain the situation, and if he thinks you can do the job whilst taking your Xanax and be safe, he'll sign it. If he doesn't think you can, well, you're fucked.
For them to outright say that you 100% can not have the meds though...yeah, not so sure if that's legal or not.
Wouldn't be surprised if it was via loophole/small print etc. though.

Actually it depends on where you live, but essentially, yes, it is legal for them to do.

If your medications make you unable to do your job or a hazard at the workplace, then you need to pursue a different profession.

What do you do? While it isn't a right to take medicine, it is a right in some states to not be discriminated on the basis of mental or physical handicap, so long as required duties are able to be fulfilled.
BTW, if you're under 18 and you're parents didn't co-sign, then they can't do shit about that contract.

It doesn't matter what you sign, if it goes again the law it's not valid.

Re: Is this legal
Let's look even beyond this - you make friggin' bread all day. If you can't do it on your meds then your meds are probably too strong anyway.
Although I do love bread.

I'm assuming that the prescription that OP is using doesn't interfere with his ability to work (as is alleged to be true by OP), and that the contract was not cosigned. If OP's employer were to randomly drop him, find the rx drug, and fire him, then the employer would be liable for damages on the basis that it is illegal to discriminate solely for a non-interruptive mental disorder.
Under Title 1 of the Americans with disabilities Act( § 12111–12117), employer's cannot discharge a person for mental disability, so long as the rx drug is legitimate, and that the OP is clear of any other unauthorized illicit substance. This is a federal law. Say OP is rxed xanax for anxiety attacks. As long as these attacks do not occur often, and business remains uninterrupted, then OP should be within the limits of "reasonable accomidations".

Re: Is this legal
pretty much said before but you sign away all your rights the day your hired. hell the constitution means nothing to them once you start working for them.
also if you do get fired it wont be for taking meds it will be something vague that will avoid any lawsuits like you were not following procedure or standards then follow it up with a million little things you did/didnt do.

Re: Is this legal
Dude, in out state your employer doesn't even need a reason to fire you.
So most likely, even if they fired you for that shit, they'd just give another reason and make it okay.

Re: Is this legal
If I were scripted something for a psychological disorder and my boss said I couldn't be medicated during work, after a couple weeks I'd fake a panic attack or act out a Vietnam flashback throwing heavy objects at random people while screaming "SEMPER FI DO OR DIE!!!"

'Practicing medicine without a liscence' is illegal in a number of jurisdictions, and this may well fall under the federal ADA in the US - they can bar you from certain jobs, but have to make accomodations to find a job your "disability" (whatever medical condition) can still perform.
This doesn't prevent an employer from firing you *without* a reason. It just means that while you're screwed suing for being fired (unless they're really dumb and give you a written statement suggesting they're doing so for illegal reason), you CAN - possibly, I'm not your lawyer - take the paperwork they already gave you, get several people locked in prison, and then proceed to sue the crap out of the company for reasons unrelated to whether you get fired or not.
