Dealin' (rented cars)
I don't know if this is the right place to make this but I'd assume there are dealers that browse BLTC or people who know their shit in regards to this question. Google has failed me so I'm looking for a straight forward answer from someone that knows the Canadian law concerning this matter
I was told by someone I met that the local dealers use rented cars because they cannot be searched by police (and for another obvious reason that I'm positive is factual). I personally don't believe it. Can't police search any vehicle on reasonable suspicion?
Note: I am NOT a drug dealer. I'm simply just asking this question out of curiosity.

Not sure in Canada, but in the US it goes a little something like this. The Roads are government property (funny how taxes pay for the roads, but...) therefore anything driving on them is public property and can be searched. Word of advice. Don't be a dumbass while driving. Use turn signals (make sure they work), follow speed limits, stay in the lines, wear your seat belt. You can't be pulled over just for the hell of it.

That's what he meant, as long as you are in any jurisdiction, you are subject to their probable cause. The only way to avoid this is to move to a different country, or to a place with no government.

I don't think that's what hew meant since it doesn't matter if it's a public funded road, a private toll road or even a private driveway. Either way probable cause is needed to search the car without permission. Of course they can tow the car and go for a search warrant.

Let's say a person has an assortment of drugs concealed in their car. A cop pulls this person over and smells a faint scent of weed lingering from the interior of the vehicle. Can the automobile be legally searched by the police officer without hesitation or does he have to contact the rental agency before committing the search; making for a time consuming hassle?

The moment you tried to say they weren't yours, the cops would most likely fingerprint the bag and link it to you, and barring that, you would still have a flimsy ass case, rental companies throughly clean the cars after each use, and go over them with a fine tooth comb. Unless you put the shit inside the gas tank the rental agency would have found it, making you a liar.

No the reason they do that is usually because they need lots of cars and cell phones for their workers...and you would be suprised how many crooked fuckers own car dealerships. Really suprised. Oh, and usually you can find someone at T-mobile shops to get you a ghost phone.
And the cops can and do search them in Canada. If your in a high crime area they don't really need much more probable cause. Don't drive with a hat on. Dress in 'working clothes' too just semi grubby average joe clothes so you look like you work for a living.
EDIT: Rented cars are more average looking too, not some flashy car or a beater. And keep everything in the trunk.

But if you hollow out a compartment in a rented car and they manage to find the contraband you could at least have a good argument in court provided you have a good lawyer. They'd have no evidence to prove that you were the one that placed the drugs there as the number of people that have used that same vehicle could well exceed over a hundred.
Maybe my logic is a bit off or I'm missing something.

The rental company goes over them with a fine tooth comb and would find anything you could install. They are inspected to prevent people getting bright ideas like yours, as well as several other reasons.
You go to court, say you had no clue it was there, car company comes in and says NO, we inspected that shit and it was fine, that shit was NOT there when we gave you the car, and you are fucked.

Stupid noob, you're a pretty smart guy, but I guess when it comes down to law, you're a little lost.
Just because a cop may suspect a crime, it doesn't give them probable cause. They have to have SOME type of evidence to perform a search. Evidence gives cops probable cause.
Evidence could be them seeing a roach, or some bud in the car when they walk up, or evidence is the dog that smells the drugs, etc.
Also, in most jurisdictions, the officer can't even search if he smells weed. He has to be trained in smelling weed to conduct a search because of the stench.
If all it took for cops to search your car was a little suspicion, than that'd be just like randomly pulling over cars and searching.
Just don't allow searches regardless.

if im not mistaken, in the US, MOST police ask for permission to search your car, if they do not have probable cause. However, if you deny their permission, a drug dog WILL be called, and the dog WILL search the perimiter of the vehicle.
If drugs are found, aside from the legal trouble youll find yourself in, they WILL seize the vehicle, whether it belongs to you or not, and it costs thousands to get it out of impound from a drug charge...if its your car. If its not, (be it a rental, a friends car, whatever)the owner of the car is responsible for all towing fees, & impound charges. NO rental company is going to get their car from impound, when they have legal documentation saying that it is your responsibility....so, youll be paying for a rental car, that you no longer have, and you wont be able to get it...even though youll pay for it in its entireity. any illegal activity by you, null & voids the contract with the rental company. my opinion? buy a junk car for a few hundred bucks, fix it so it runs good, and use that..wont draw much attention by being a newer car, and not much of a loss if you do get popped...plus, its your car..you can do whatever you like, in terms of stash boxes, hiding spots, etc...

I walked around the car to get a better look, and I saw shattered glass in the passenger window. Someone stole some shit... and as I smoked my cigarette, I watched him dust parts of the door and shit.

umm, yea...all of that looks good on paper, telling the cops to piss off and such, but, as someone that has been in the situation of search & seizure several times, it sounds to me that, though you MIGHT know what SOME of the laws are, you OBVIOUSLY dont have a clue when it comes to dealing with the police...either that or you come from a small town, where the police actually abide by the book.
If you were to tell the cops to piss off in my neck of the woods, you would be handcuffed, get your ass kicked, and on top of that, they WOULD find drugs in your car, whether you had any or not. probable cause can be looking like a teenager in a bad neighborhood. thats it. you spoke abnormally? oh shit, probable cause! you say no? we bring the pooch! they don't need a warrent if there is probable cause, which has such a loose definition that its bullshit to even bank on, unless your car is parked in your driveway and your not in it when mr bacon shows up..
we american's don't have it easy, not only can we get "breath tested" at random, but now the collect all of seatbelt checks means you can and may find yourself getting pulled over and searched for no apparent reason [well maybe not if you were wearing your seatbelt].

There's nothing to do with logic here. And just because you mention probable cause, doesn't mean you know anything about it.
You plainly stated that if they SUSPECT a crime they have probable cause. Suspecting a crime and having evidence related to a crime are completely different in establishing probable cause. Suspicion only gives officers the right to stop and detain momentarily, to ask questions, nothing more. Now, if they establish probable cause while talking with you, than they can search. But to establish probable cause they have to have some HARD evidence, although it doesn't have to be much (IE roach in ash tray), it does have to be actual evidence.
When it comes to law, definitions, and logic, YOU are the one lost.
I'm in my 3rd year of a BA in Political science, I'm assuming based off of that and all my other research I'm a little more knowledgeable on this subject than you, especially considering I've been studying for the LSAT and am taking it in aprox 6 months.
The only LEGAL way the cop is going to search without a warrant is either A) a dog
or
B) They'll arrest you for a minor traffic violation and than search your car completely. (Atwater v city of largo vista 2001) (Whren v United States 1996)

rereading your post leads me to believe that all of your experience with cops is from books or movies...if youve never been busted, what the fuck do you need an attorney for? are you leading us to believe that your so "plugged in" to the underground networks, that you just have a lawyer at your disposal? I call bullshit on your logic. Not all police abide by these laws that you have so much faith in.
Like I said in an earlier post, come to my town, and try and put your phone on speaker while being questioned, youll get your ass handed to you by these militant assholes.

You plainly stated that if they SUSPECT a crime they have probable cause. Suspecting a crime and having evidence related to a crime are completely different in establishing probable cause. Suspicion only gives officers the right to stop and detain momentarily, to ask questions, nothing more. Now, if they establish probable cause while talking with you, than they can search. But to establish probable cause they have to have some HARD evidence, although it doesn't have to be much (IE roach in ash tray), it does have to be actual evidence.
When it comes to law, definitions, and logic, YOU are the one lost.
I'm in my 3rd year of a BA in Political science, I'm assuming based off of that and all my other research I'm a little more knowledgeable on this subject than you, especially considering I've been studying for the LSAT and am taking it in aprox 6 months.
The only LEGAL way the cop is going to search without a warrant is either A) a dog
or
B) They'll arrest you for a minor traffic violation and than search your car completely. (Atwater v city of largo vista 2001) (Whren v United States 1996)
Things dont always work out the way that youre being taught...i respect your responses, you know your shit...but the way the books are written, and the way that they apply to real life are 2 totally different things.

You're just pissed off because you don't know shit about the law or how to handle police and you got your ass handed to you because of your stupidity. Yes I've been pulled over (who the fuck hasn't) and yes every time I refuse a search they threaten to get a dog on me. But guess what, unlike in all the rap movies you see, drug dogs don't fucking grow on trees, and the trainer rarely feels like dropping whatever they're doing (probably more important) to search somebodies car. If I got my phone on (poor mans camera) and I think he's going to do something stupid, all I have to do is provoke him to say something incriminating. It would be rare a cop doesn't go on a head trip and say he's tearing your car apart because he's god. Then if they actually do something illegal, you don't need money for a lawyer cuz you got yourself a possible million dollar case, giant news story, and possibly a book deal if the cops are known to be corrupt.
Also, you must look like a bitch to have a cop think he can plant drugs in your car and you won't do shit about it.

and FYI, ive never consented to a search, and yet my car has been searched anyways. Like i said in an earlier post, not all police go by the book.

Wow a lot of really dumb and plain untrue shit has been said in this thread. So, a few things:
Citizens do NOT have the same or even nearly the same right to privacy in their car as in their home. The only way an officer can legally search a person's home is if they obtain a warrant from a court. In your vehicle, any officer can legally perform a search (with your permission) if he has probable cause to search the vehicle. In order for probable cause to be established there must exist "specific and articulable facts that support support suspicion" you have been involved in criminal activity. In principal, these facts should apply to only a narrow range of behaviors, but in practice, they encompass quiet a lot.
Of course, you can deny the search, even if the officer has probable cause. Whether or not a canine unit is called really depends on the specific police force you are dealing with. Obviously, in a high crime area if you are pulled over for suspicious activity and you deny a search they're probably going to call the dogs, but if you are dealing with a smaller force with less resources it's not really worth their time.
And as was previously said, the application of US laws, especially in regard to individual rights, are often very different from the principles they were created from. I had an officer search my vehicle (without permission) after he detained me simply for driving away from a head shop. I had committed no traffic violations, my registration and license checked out, and whenever I asked specifically why I had been pulled over he avoided the question. The way the laws are written and the way things actually go down when some cop is staring you down are totally different.
Of course, if the officer blatantly breaks the law you can likely get any evidence against you suppressed and you'll probably get off clean but just having to deal with all that is a huge hassle. Just be smart, know your rights, and understand that NOT PROTESTING an officer's attempts to search your car, even if he never directly asked you can be considered consent.
One last thing, this isn't as relevant, but seriously don't drive like a fucking idiot when you have drugs in your car. I'd say at least four out of five people I know who have been busted on the road originally got pulled over for minor traffic violations, problems with the car, etc. Just maintain your car and drive the speed limit, it's really not that hard and it'll really save your ass in the long run.

what does your "super attorney" do for you, if youre too "untouchable" and smart, for the cops to even get close?

I saw your location, and I'd have to agree with you there. Detroit and many other larger metropolitan areas are known for having dirty fucking pigs.
And also like you said, you may not have the money for an attorney. I, fortunately, have pretty wealthy parents whom have actually asked on an occasion if I was going to need them to pay for a lawyer for me (Friend was in trouble, cops came over to ask questions, parents got worried).
But still, you should be prepared for what you have to face on a daily basis. Know your rights still, because even though it may not save you, there's still the possibility that it will.
I think if a cop ever does me dirty like that, that's going to be the breaking point for me... This country is really starting to piss me off, especially the stupid redneck ass police.

I can also guarantee you that a lot of those country bumpkin cops you think are so clean do whatever the fuck they want in their town. You piss em off and you might not make it home for a long, long time. They don't have internal affairs out in the woods boy. I get a lot of advice on how to deal with police (other than just time spent talking to my lawyer) from a guy who has been in a very bad situation. He was a punk when he was younger and 2 cops just had it out for him as soon as he turned 18. He recorded a couple of his encounters with them and gave it to a lawyer who got his record cleaned, car restored, and a huge ass settlement that paid for his college tuition. The cops got fired and barely got out of a jail sentence for the shit they did to him. Guess what he decided he wanted to go to school for? That's right, to become a lawyer. He's the one I originally got the voice mail idea from. It worked for him so it will work for me. I first started talking to an attorney when I had a very serious wreck when I was younger. He took very good care of me and I came out without any problems or stress. They know how to deal with insurance companies and court rooms and police. He explained in a pretty short conversation exactly how to handle police once you are pulled over and more importantly, how to avoid them.

Most people are dumb fucks who don't know the law. I think I'm going to listen to a lawyer or maybe read a book on my states laws before I listen to some dumb, gutter trash with third hand knowledge of how they think the system works based on what someone saw on BET once. If you have a question, look it up or call a lawyer. It isn't difficult to find a lawyer that gives free legal advice or to find a law student who can tell you your rights. The system preys on ignorance. You are ignorant. You are the next meal. You see, in the event I get pulled over I will know exactly what to do. If the cop decides to cross the line and I end up in court because of it, my lawyer will tear him a new asshole. You don't seem to fucking understand that what happens in court is all that really matters. The court decides what happens to you. The court decides what happened the day you got arrested. The more you do and record on the scene of you playing the game right, the more your lawyer has to work with, and the higher you chances of coming out on top are.

thanks for the respectable response...and im not even saying that all cops are dirty, but most that i have encountered, do not abide by the book. Detroit is a huge city...even the suburbs have several drug dogs at their disposal, and being so close to the canadian border, everyone is under suspicion. dearborn police, (detroit suburb) searched my moms car, claiming to smell weed...she denied permission, he searched anyway. of course it was thrown out of court, for illegal search, but do you think she got reimbursment for them tearing apart her car...removing panels, speakers? my mom is in her 60s, and never smoked weed in her life..she now fears police, and avoids driving whenever possible...redjoker believes that, since i dont agree with him, that i am white trash, and stupid. i guess thats a fair assumption from someone, who, other than this stupid thread, has never spoke to me, and knows absolutely nothing about me.
this country is a joke, and all the dreams we have been made to believe about it are a joke. europe, here i come...anyway, good luck to you, we need open minded people like you in the system, maybe, with your help, we can get this country back on the right track.
my family grew up poor, and it took alot for me to get out of the environment that would for certain set me back. I have a decent job, I make enough money to support my family, and still save. sure i have my vices, and I do what i have to do to survive, but Ive learned from my mistakes.
