You're completely fucked and that's why they're stupid tests. It's pretty ridiculous because a daily smoker will always come up as positive for cannabis inebriation. Obviously, their brain's definition of sobriety is completely different.

I have always heard if you are aressted the cop gets to pick the type of test. But if you try and demand anything I gurentee he will take you in and give you the bloodtest.

what exactly is scraped off your tongue? is there any way to get it off yourself...like just brushing your tongue or using your own scraper? or are you just screwed?

If I'm not mistaken, it's only been used so far in Australia. I doubt there's anything you can do about it... they only need a very small amount of saliva or cells. I forget which.

I got one where you hold a cotton swab in your mouth when I applied for a job and it came back negative, but I hadn't smoked in like a weed. They claimed if I had done any drugs in the past week it would catch it however I think it was probably scare tactics to make me think they would be able to know. Thats bull if they can hit you with DUI and a test claims it can get you for a drug in your system up to a week ago. Also as far as I know, there is no law against having a drug in your system as long as you dont posses it.

Yeah, it's not illegal at all to be under the influence of a drug unless you're driving technically. A lot of states have these stupid "Drugged Driving" laws.

It basically means, if an officer "has reason to believe" you're under the influence of a substance they can drag your ass in to the police station to be tested. This is a full-screen drug test too, anything and everything goes on it. You could have eaten a lemon, poppy-seed cake earlier in the day, tested positive for opiates and you have to sit your ass in the slammer until you can somehow prove you innocently ate cake instead of shot up heroin.

Of course, the details vary from state to state. Not all states have the absolute no tolerance policy that I illustrated above. The number still isn't small, 10 states. Of course the laws vary and some states are more lenient than other but the hypocrisy of ALL of them are ridiculous. An example being my home state, Minnesota. It actually explicitly states that people are guilty of Drugged Driving if they test positive for any schedule I or II substances EXCEPT marijuana metabolites. It seems pretty silly to me that they'd use a rating system on drug severity and then admit in the same law that it has flaws by making an exception.

That seems almost unconstitutional to be able to book someone for a suspicion, something that the cop could easily lie about with no proof like red eyes, but then again in today's world I'm not surprised in the least.

Well in Australia, you must consent to a breathalyser. But they can only test you for drugs once you're under arrest. And they can't arrest you without reasonable suspicion you are under the influence of drugs.

Yeah, i've been there. Just be courteous and polite. I've heard some fucked up stories, but most of the police i've come across have been pretty nice.

Except for that one time this policeman tried to book me for "obstruction of justice" or some shit.

Welcome to Australia, we have drug bus' here. Same as the bretho's just they test for mdma, amps and weed. Apparently their test for weed only works if you have had it "several" hours earlier, according to their website atleast.
