so if they are illegal to use and cultivate how the fuck are fresh ones still legal?... if i was to go there right now could i buy some fresh shrooms?

It's probably similar to the old UK law - "Not for human consumption". It's legal to sell them for "research purposes". It's a loophole. Eventually in the UK they banned them altogether, but they still grow wild all over the place.
