failed a breathalizer
i got this wonderful court ordered box in my house that randomly calls and checks my BAC. i had it last summer as well, so i know the ins and outs of their system alright. when it fails, it doesn't just tell you that you failed, but it makes a different tone and they call back in 10min. this happened last summer and i was locked up even after trying to use the excuse of cough medicine. last night me and a couple friends got hammered fuckin knee walkin drunk, i got in sometime between 3-5am and passed out on the couch. 9am the phone rings and i take the breathalizer and fucking failed. i see my PO on thursday.... any ideas of what i could say that might keep me outta jail? cough medicine failed... i'm thinkin i should say mouthwash? or somethin.

i'll take rehab if she wants more than a few months in jail. if it's a choice of 30 day rehab vs 30 days in jail, i'll take the jail with work release.

Damn. I would definitely say that you just used mouthwash right before you took the breathalizer. You took it in the morning, so thats probably your best chance. Im not going to say it will work though cause I have no idea what you blew. Isnt their anyone around that could blow for you? If the PO isnt around surely in ten minutes time you can find someone and pay them 10 bucks to blow in it for you.
Between what hours are you supposed to stay at home?

weekdays i can't leave until 1pm and have to be home by 11pm (2nd shift)
weekends i have to be here the whole time. no one else can blow for me because it snaps a little picture as well. maybe blow up balloons while sober... then some how conceal the balloon and let it blow into the breathalizer??

I blew a .2 when I was driving at 19 years old. Told the officers I just used mouthwash, and they took me in for a feild sobriety test and an additional breathalizer. The second one I took I had 30 minutes to call a witness, which was enough to get the 2 beers I drank out of my system, and I blew a 0.0. Case was dismissed.
Im not saying it will work, but it might be better then just admitting he was drunk. Especially if he only blew a few points over 0.0

Indeed, but in this case, I think providing a witness will be far more difficult for him to swing. If they're checking up on him enough to warrant this fascist setup they're using, I don't think the mouthwash routine will work.
Hell, if it did, this would be the first time I've ever heard of the mouthwash claim working period.

yeah. i agree it's a better defense than admitting it. admitting it is what got me here. me and my buddy left the rig and got a couple 22ozers. we got stopped, we both blew legal, but i'm on probation so they reported this to my PO. i admitted having a couple beers after work, next thing i know i'm blowin in a damn machine every couple hours. admittence is a ticket to jail. for sure.
but like i also said, i tried the cough syrup excuse last summer and that was a ticket to jail too.
maybe absconding is the best choice.

Switch to benzos maybe, and study for your drug tests, it's out of your system pretty quick anyway.

Of course, take a picture of yourself blowing into the machine from the camera's POV, set it up in front of the machine, then build a vastly elaborate mouse-trap type contraption (you know, with rolling bowling balls and dominoes and magnifying glasses burning a string holding a cat over a pot of chili, that sort of thing) set up to empty a balloon of your breath into the machine every time the phone rings. Bulletproof.
And for your current situation, just tell the judge your drunk mom was yelling at the BAC thinking it was the telephone.
edit: Oh, and add on that your mom was wearing the mask of your face that she wears whenever she's had a few.

Did you read what you signed when you first went into the probation office? Most probation agreements, when they forbid alcohol consumption, forbid all forms of it. For example, they will likely forbid the use of any products containing alcohol and explicitly forbid the use of a mouthwash that contains it.

i usually only drink when i know they arn't gonna call for awhile and i don't usually drink as much. but alcohol has a way about it, where you stop caring about consequences. other drugs are not an option, piss tests. and my company is threatening hair folical tests in the near future.

Haha 2 DUIs? I got 2 in a two year period and the worst thing that happened was that my license was suspended for 6 months. I drove those 6 months anyway and didn't get pulled over... and I was 17-18.

so here's what happened - she wasn't buying the mouthwash theory, so i half admitted it, i said i accidenty took a drink of my roommate's drink from the previous night. i was reminded of the rules saying i cannot have any alcohol in the house at all. i said i told him that and that i didn't know he even had the alcohol. she pretty much warned me and basicly since i have my fines paid is the only reason she isn't going to violate me. also she said if i blow anything ever again i'm getting 3 xtra months with this machine and she'll recommend out patient treatment.

and yes they are very rude, they call at all hours of the night even if i have to work.

That's retarded. Some of my friends worked on oil rigs and they said pretty much everyone uses drugs there, so I'd think that everyone would shave their whole body if they were threatened with a hair test.

some places don't test. when working for McLachlan drilling the tool pusher would get high with us right while working. now i'm on the 2nd biggest rig in the state, working for a crew that is all "straight laced" (except for getting shit faced every day after work) well worth it, i'll break $100k this year if i stay with them.
but it is true that most smaller drilling companies don't care and most roughnecks are known for thier drug use, paticularly coke and meth due to the long hours and long drives.
edit: i wasn't saying that because of the occupation they test us, i was meaning that because of my occupation and everyone's knowlege, it would be obvious why i took all my hair off and hey'd probably start piss testing us every week.

exactly. also it is voice authorized for anyone thinking of trying to outsmart it in the future.
there's a little nub that i can see down in the tube that i think is what checks the BAC... i was thinking, what if someone put a drop of hot wax on this nub and let it harden... this might isolate the checker. or this could be another felony!

i've never been caught drinking and driving. i was drunk and assaulted a cop then got caught drinking while riding home from work. my girlfiend usually plays DD for me since if i lose my license i'd probably lose my job (depending on how long they took it)

I know lawyers use a nifty defense called "mouth alcohol". If you JUST used Listerine, you can blow a .08 easily just by mouth alcohol, those breathalyzers are CRAP! And next time you're wasted and they call to breath test you REQUEST a BLOOD TEST!
If YOU request a blood test, by law, it's THEIR responsiblity to get your BAC. You're not refusing, so they can't bust you with that. And most POs are lazy assholes who aren't going to come to you just to blood test you, they're job is to make phone calls...
