Okay so last year I was arrested on a possession charge, went to trial, and somehow, with a great lawyer, wound up with the charge being deferred for 90 days...

No one at the courthouse, not the judge, prosecuting officer, or even my lawyer, mentioned anything about ever getting a drug test, but two people I've talked to since the trial who are very knowledgable about the South Carolina law system said that after 60 days my lawyer would recieve a letter about me being called in for a drug test...

Has anyone ever heard of this? It seems rather ridiculous to me, considering the charge is being deferred, and what could they possibly do with it in your system if its not in your possession?

Well, its been nearly 2 months since the trial, and I have not stopped smoking and take opiates occassionally. I was just wondering if anyone knew about this, or if it was a load of BS? I dont know what to expect... or if i should clean up or not?

Oh awesome thread! I'm in the exact same situation.

BE CAREFUL! I was in a situation where I passed my initial (baseline) drug test for the same kind of shit your in, only I was on unsupervised probation for 6 months.

My lawyer told me that if I passed the first drug test and they didn't give me another one within 60 days, then I wouldn't get another test. He told me that he had NEVER heard of anyone getting another one (after the 60 days and passing the baseline test) because after 60 days court services stops keeping track of your file (unless you get in trouble again) and when your on unsupervised probation you don't have a probation officer.

So 60 days and a week go by and I figure I'm safe so I started smoking again. Three weeks later I get a letter calling me in for a drug test in 4 days. I was able to get it extended to 10 days due to college exams, but it was still a bitch to get clean for. I posted exactly how I got clean in the last couple pages of the how to pass a drug test thread.

I also have buddies who recently experienced the same thing, despite my warnings to all of them. One of them is in jail because he trusted a detox drink like an idiot instead of doing what is required to get clean. We live in IN, but I would still be careful with the whole deal.
