That's nothing. I read a better story in the news. A man found out the kid wasn't his, and so the woman left him to live with the real father, and the cuckolded guy had to pay child support to her, even though she was living with the real dad. Then, she basically up and runs away, and no one can find her, so the real father of the child keeps the kid, but the court makes the guy that was tricked start paying child support to the real father.

A lot of people here have the misconceived idea that a prenup will save their ass in court. They are wrong for several reasons:
1) a prenup only covers assets that the person has before the marriage.
2) a prenup cannot stipulate child support or wage garnishment or alimony payments - those are all products of the marriage and as such if you are not married you cannot stipulate them.
3) any bank account you ever withdraw from - even once - to buy something for the marriage, immediately becomes joint marital property, and as such the wife is entitled to half.
4) the house is joint marital property, so she gets half.

So basically, anything you have going in is safe, unless you do something stupid like put all your money into one account, or withdraw from your account to buy shit "for the marriage" which can be anything - a candy bar, toilet paper, or paint for the house.

So there you go. Prenups will not save your ass. If you're rich or have significant assets then it's the way to go. Otherwise it's pointless. Just don't get married and you can't get divorced. "Don't get divorced" is stupid advice. You never know if your spouse will cheat on you or just become completely intolerable. The best option is to simply not marry.

Funny thing, my GF is all like "people shouldn't live together before they're married" and I'm telling her that a marriage is much more likely to fail is all the stress is put on the couple at once. If you live together, you get over the stress of that early on, then you can get over marriage problems more easily without having the added frustration over who washes dishes, cleans, etc.

On the flip side, people should be more willing to consider divorce rather than staying together and being miserable. My grandparents were together for 20 years after their marriage fell apart before divorcing. Partly because they were Catholic, and partly 'staying together for the kids.' According to the 'kids' (my father, 3 uncles, and 2 aunts) they all would have been happier if their parents had split up sooner.

In order for the document to be filed it has to be signed by a judge. Then, once it goes to the clerks a few minutes later and gets its lovely file stamp, it takes effect immediately, unless the temporary order stipulates the amount to begin on a specific date. Usually it'll start a couple weeks after the documents get filed.

In any case, the temporary order takes effect and has precedence until the final order of judgment and decree of divorce gets filed, which usually takes a little while. In any case, the guy has to pay $6700 if the judge signs the temporary order and it gets filed. In the final order that number may or may not change. Usually it does. Oh, and if the guy doesn't start paying when the temp order gets filed, he'll owe a shit ton of money in back child support.

In short: once the papers go to the judge, the guy is fucked. Don't trust prenups because they cannot stipulate child support or alimony. So the best thing to do is simply never marry.
