Default Lying In Court?

I was suspended from school because of possession of Adderall. A cigarette pack that they were in somehow fell out of my inside coat pocket and an assistant principal saw it and took them. When I got called down to the office, I said I kicked something once I got off the bus, looked down and saw the pack, and pocketed it with the intention of giving the cigarettes to my friends. That was my story to my principal, the one that saw me do it, the SRO, and the officer at the juvi center.

It was to my understanding that the cops threw out the report because they had no evidence that I did it. They threatend to fingerprint the bags the Adderall were in, and I never said yes, but I never said no. My parents backed me up and told the officer they thought I was telling the truth because "(I) admitted to worse than this in the past." Then my dad told them they could put me up to a lie detector test. (I think he wants me to get caught honestly.)

Now I have a 60 day out of school suspension and have to go to a voluntary alternative to school for the rest of the school year so I can get my make-up work privileges. They also do drug counseling shit that's no better than D.A.R.E. In order for me to get into it, I had to get drug tested and see a psychiatrist so he could sign off that I am seeing someone to help me with my "drug problems."

Yesterday, I received a letter that said my parents and I have to appear in court. I know my dad has or will get a lawyer and will fight until we win. But my question is, should I just keep my story since that's what I've been saying? What extent will they go through to win this case? Or should I argue that they are doing this much just because I picked up a pack of cigarettes that happened to contain a controlled substance?

Previously, all the trouble I've gotten into at this school and all that they know about is is a tardy warning (been late to class 5 times,) that's my record. As far as grades go, I have like 4 A's and 2 B's. Both of which I've been told will help me.

Most people on this forum would say DENY DENY DENY! Your story is however very sketchy. I mean - come on..."I swear officer! I didn't know there was drugs in my cigarrette pack!"

I also thought that lie detectors aren't used in situations like that on account of their unreliability?

Next time, keep the fucking pills in your sock or something. They're tiny little things! Putting them in a cigarrette package was a stupid idea, so I guess we can (sort of) chalk one up to Darwin.

I'm pretty sure they wont use a lie detector, that would be a waste of their time and money.

I'm thinking of just saying guilty because I don't want to waste more time. And I'm hoping that they won't want to fuck up a kids life just because he had pills.

I've been keeping pills in my cigarette pack for years and never had a problem. Anyways, I would have been searched and they would have found them either way. Plus, in my experience, Adderall break easily and probably shouldn't be in someones sock. That and I wouldn't want to something in my mouth that was touching someones foot for a few hours.

Court loves to fuck your life up for drugs. I'm being financially forced out of college because of court and I was on the fucking deans list last semester [that's a big deal]. I now am pretty much going to have to drop out and work full time for a few months to pay the fucking $2000 Iowa wants for a joint worth of grass and a pipe, unless they're willing to wait a few months for their money...

I will always have two incidents of misdemeanor marijuana possession on my record, possibly barring me from the fields of employment I was getting a degree in...

Kid, if it's not the drugs that get you, it's what society does to drug addicts that will....

Why do you even have to ask. Just lie, obviously there is no real proof, and it isn't a huge fucking deal, go to court, and act innocent, because there is NOTHING to worry about.

Well fuck how are they going to prove it? I mean, if I get a lawyer and don't change my story, they can't just be like "... You're lying, go straight to jail, don't pass go, don't collect $200" can they?

On the other hand, if I admit to being guilty, what do you think the punishment would be for a minor to be in possession of Adderall with intent to sell on school property? But I think it might just be a possession charge.

thats gay, possession here was just a $100 fine, $300 after court/jailing fees... You can have any payment put off for up to a year here, at which time if unpayed you must be in court again to (more court fees) to setup something or ask for more time, which is what im about to have to do... I owe approx 1100$ in fine/court fees, damn fines...

Stick to your story or you're fucked. It's a fairly good story albeit sketchy but they cannot prove that you're lying. You're going to get punished anyhow but if you stick to your story you might get some leniency. If you change your story that's when they'll label you as a liar and a drug addict.



Also I feel bad for Evil_Tree... I'm so glad to live in a state where it's decriminalized. They just give you a ticket and half the time it's not worth their trouble so they just blow it off.

Well if you live in a city, especially a large city, for something like that, wich I believe is a misdameanor drug offense, Your lawyer can get it to where it never goes to court with just a little money, any ways It would cost them to much money , to test, pay attorneys, and just to much time for such a small case of a I'm guess juvenile? But if your in some bumfuck west bound sighn town your fucked.

How many did you have and how old are you?

They aren't going to do shit in court, probably just have to pay a small fine and maybe some unsupervised probation, IF that... If you are under 18, it probably won't even be that.

I live in Iowa City, a town that prides it self on it's 'open minded liberalness' [meaning they love fagots and homeless people]. The chick that was arrested with me got a 500 dollar fine for having a twenty sack $300 in court costs $400 to be on probation [unsupervised] and 24 hours of community service. And that's all with a differed sentence and first offense. I had like .5 and a piece and am still awaiting court and it's second offense. I'll get max fine on both grass and parphanillia and get a huge amount of community service, trapping me in Iowa where I have no business contacts so I have to work my way up past minimum wage to pay living costs and these fines. If court goes the way I'm expecting it to go and I can't get a extension on the payment I'm going to have to drop out of college [Where I'm succeeding achedimically] and get some shitty manual labor job surrounded by criminals where I'll be likely to continue my drug abuse. It's a fucking trap. I fucking hate Johnson County Iowa...

They sent more than half of the police force available to come arrest two kids sitting by the river smoking grass on a Saturday night. I cooperated to the fullest, never raised my voice or spoke in an aggressive manor, yet they still shoved me around and treated me like shit. When I get to the station they set bail at 1300 dollars so I had to spend the night, they stripped searched me and preform a cavity search, and were about to taze me because I questioned the nessesity of it. That's pretty much the definition of rape, forced entry at weapon point, but no, that's legal in Iowa...

But the thing that pissed me off the most was the next weekend these two drunk dudes were beating the shit out of each other in residential as me and my friend were walking home from a kegger. Three squad cars are there in a manor of seconds and the pigs that stepped out were the same pigs that arrested me. They pull the dudes apart and send them on their merry way. Some how, me smoking bud and looking at the stars with some chick is worse than being a belligerent asshole and beating other assholes up...

Iowa city huh? I had no idea that penalties were that extreme there.. youre the closest totse member to me ive seen thus far.. im about 65 miles south of you.. and i guess the county or city statutes / laws must be different cause its nowhere near that steep here. You might receive a $250 fine and unsupervised. although you will get your license suspended for 6 months..

Catch this, a fucking fellow student dropped the dime on us...

There's this big bluff that runs parallel to the river, and they trapped us between it and the river by sending in five cops from both sides. There's like thirty something cops total in the whole city, they sent more than ten of them to a pot smoking call...

Yeah, you see, your DA is cool, the DA up here loves to fuck pot heads. They can give you the same charge for possession of an unmeasurable amount that they would for a few ounces. They tried to get this dude I know on intent to sell because he had a two bags with shake in them in his car. Like the tiny bit of grass you can't get out of the corner of sandwich bags...

I've got an out of state license, so they can suck my dick,, Jessie White ain't suspended that shit for smokin' herb...

To the OP, if you plead guilty, that shit will drag on anjd on and on. Back in Septembe, I was caught at school smoking a cigarette, and when they searched my car, they found bottles of valium, lorcet, darvocet, and old-ass amphetamines. I had no idea the pills were there, since I'd only purchased the car a week before, but they still took me to jail, since I had a nick sack in my pocket. I had no record, no priors, nothing that would give them reason to throw me in jail.

NOW, I'm STILL going to court, (We postponed the trial like 8 times ) and I'm getting probation and a heavy fine. BUT, my lawyer's saying there's rumors going around that they should arrest me for DRUG DEALING, since I possessed a lot of pills in the car.

The fucked up thing is - The pills had all expired back in '94, '95, which were the dates on the bottles. The pills were so old, they would have noi value, and yet the cops still fucked me over with them.

how did the principal get the cigs from you? did he threaten you to hand it over or did he ask for them? also is possesion tobacco for minors illegal there? do you have a school handbook that says anything about possesion of tobacco?
might be able to get illegal search and seizure then possibly sue the school for having to go through that traumatic experience you were falsely accused of.

there was one supreme court case i remember vaguely that was similar to this. i think the student walked out of bathroom after a cig. someone saw him leaving.student was forced to hand over his backpack and was found guilty on possesion. which was later overturned for illegal search and seizure. they can search your locker because its not your locker. they cant search you or your bag. schools arent theyre own country they are still on us soil. constitution last i heard was the law of the land. if a cop cant do it why would a school official?

no institution can make rules that contradict the constitution or deny your rights. granted alot do doesnt mean its right.

Jessie White like a mother fucker, you know that negro smoked herb in his day. Have you tried to get your fine put into monthly payments of like $25 or $50? I don't know if they do that in Iowa but in IL i know you can do that, probably depends if the judge or DA will let you, Im not sure which. Probably the judge.

you're a juvenile. this whole thing is a joke. misdemeanor simple possession, probably one year probation if you plead guilty, make a deal, or are convicted. doesn't matter. off your record to the public at 18.

lie. change your story and they'll want to come after you. even though it was a shitty lie, stick to it. they can't use a polygraph, only your lawyer could request that. they won't fingerprint shit. labs are already backlogged with real cases anyway. and they won't charge you with perjury, even if they threaten too. they like empty threats. the trick to dealing with the legal system is to play it right. learn how, and you'll see what i mean. it's like poker.

my only real advice is for YOU to keep an open dialogue with your attorney. don't let your parents make decisions. they may have your best interests at heart but you're lying to them too, so they'd proceed as if you truly had nothing to hide, and that might lead to a fuckup.

now grow up, get out of high school, and don't be so fucking stupid.

Our school/Supreme court is gay. On a paper listing the rules of our school it says there is a ruling by the Supreme court of Canada stating they they can search our property and/or person whenever they like. Its a good thing they are no good at it though, as they have searched me and my bag and missed the joint and lighter in my bag and missed several bags of weed, joints, ciggs and the like when patting down my friends. One time the vice principal shoved her hand down my friends pocket and missed the dime bag he had in there.

Rather than DRUG charges, I would get tobacco possession and truancy. a better deal. but yeah, I know no one would think to do that at the actual time, so sorry. ;/

Plead no contest at worst or best just plead not guilty and get a public defender. Even if you lie a bit, most people in there do, and they are good and calling your shit, so just come up with a good story that makes sense and give it your best shot.

Oh and btw I'm probably one of the few men ever who have gone into a court and pleaded guilty to two counts of attempted murder,one of armed robbery, been as guilty as sin, and walked out with two years probation (the DA was demanding 7+).

NEVER NEVER LIE IN COURT.

If you can't tell the truth then say nothing or even better get your lawyer to do the talking for you.

By all means 'economise with the truth' if needs must, not tell the whole story if that helps...

But never lie.

The slightest slip and you're meat for Bubba.

How many lies do you think a judge has listened to over the years?

if you change your story now you will be in deeper shit because at this point they don't have the resources to fingerprint it, trace it back to you, etc. there's got to be some sort of benefit of the doubt there even if they -know- the stuff is yours.

some mom! what kind of evidence does she have against you that the school/police don't already?

Get a public defender, or better yet, a lawyer, and don't say ANYTHING to anyone other than your PD/lawyer.
