Medical Pot Loses a Round in Court
The CA Supreme Court held that Proposition 215 does not prevent employers from denying employment or firing a legal patient if he or she tests positive for cannabis use.
Some state legislators are working to fix this. In the mean time though...
http://www.safeaccessnow.org/article.php?id=5428
I think it is way fucked up.

its perfectly fine to be an alcoholic... or test positive for amphetamines, or opiates as long as you have prescriptions... but weed, and your losing your job...

Re: Medical Pot Loses a Round in Court
wow. surprise!
even if cannabis became completely legal, i still imagine lots of jobs would have a requirement that you can't smoke and work there. thats like saying because alcohol is legal it's okay to go to work drunk. i know its not the same, but similar
yes, i am super high, otherwise this would probably be more relevant

Unless I'm missing it, I don't think he is fighting for his right to smoke marijuana while on the job, but the freedom to use it to treat his pain off-hours. However, I guess if marijuana really is as critical to his treatment as he says it is, he would have to use it the 9 hours or so he's at work.

i understand that, man, but since we don't have advanced enough tests to tell exactly when you were smoking, it's assumed that you are smoking on the job when you test positive

No you dumb fuck, it's the same as if you were taking vicodin, or xanax, or ANY fucking prescription drug. Would it be ok for a job to fire you for taking therapeutic doses of hydrocodone on the job? FUCK NO. Because you NEED that shit to function.
Fucking christ you are stupid as fuck, or a troll, either way, get the fuck out mah BLTC bitch.

Re: Medical Pot Loses a Round in Court
Good. The government shouldn't be able to tell an employer what grounds can be used for firing.
All drugs should be legal in the first place but the government shouldn't intervene with private businesses. Yeah, the employers are dumb as shit for doing it but it's their right to run their business like they want.

Are you insane? You are suggesting that private companies can be trusted to police them selfs to do right by the community and the public - not to mention their own workers? You can't trust them to see past their bottom line.
I don't believe in a lot of gov intrusion, but there is certainly a certain amount that is needed.

I can't really agree with that. Can one get therapeutic effects from marijuana and not be stoned, like with Vicodin and Xanax? Because honestly, if you were a business owner, would you want your employees stoned on the job? Off the clock is another matter entirely...

Re: Medical Pot Loses a Round in Court
I use pot as medicine, and I can function just fine. I go to work high, and do everything high, and no one can tell the difference, well, I'm not as much of an asshole because I don't hurt as bad, but that's it. It is totally possible to function normally on weed. And yes, any dose high enough of any pill to actually help the problem IS going to fuck you up to a certain degree.
When I take .5mg xanax, people know it, but when I smoke a joint, NO one can tell. I smoke around my inlaws, and my gfs grandparents, and they are none the wiser.

Re: Medical Pot Loses a Round in Court
Yeah I agree it's fucked but, is this "law" going to be "enforced"?
As a business owner, wouldn't you feel bad if you denied someone employment because they can't pass a piss test due to the medicine they use off the job? People are reasonable, most are any way. I wonder how far calmly explaining your medical use of pot, and how because of it you can't pass a piss test, would go...'Cuz again most people are human and don't give a fuck what you do on your own time as long as you do your job well.

Reminds me of that article from Modern Drunkard Magazine about boozing on the job. "Go to the interview drunk; that way, they'll think you're naturally that jolly all the time!" :D

Re: Medical Pot Loses a Round in Court
If I was an employer, I would not want anyone who smoked pot off time, took prescription opiates/benzoz off time, or comming to work w/ a hang over to work w/ me.
The employer should have the right to employ who ever the fuck he wants for any fucking reason.
The government should not intervene and decide who the employer can hire or not.
I personally know that pot heads are effected, regardless if they are high or not. They might not be "high" when they are sober, but they are extreamly thick headed, stubborn, and lack in basic cognitive ability/logical deduction.

actually you are the one that is extremely think headed, seeing as you your argument is not logically sound. And your trying to use logic terms doesnt make sense. your second premise is not true, you are making a statements on your own background beliefs and world views and is more of an opinion then fact, and if it were a fact wouldnt you have shown your evidence???? seeing as you have no expertise/ credibility, but really just and big head and a mouth full of hot air, go blow if out on some other internet site, bitch.

I used to be a pot head and when I was, I was extreamly stubborn and lacked natural cognitive ability. I would not want my workers to be like that.
I believe employers should be able to discriminate on anything they want, including off work drug use and even race.

Yeah, because everyone reacts the same exact way to marijuana as you do. By that logic, every marijuana user is as fucking retarded as you too. Extreamly retarded.
You dumb fuck, there isn't even an A in extremely.

Hell, this practically exists in employment-at-will states, except for the race/sex part.

yes, your are correct in saying that employers should be aloud to discriminate, the point where you were wrong was when you reasoned since your lazy and stubborn when you were smoking pot everyone is like that, and thats a fallacy, totally untrue. So next time before you go ranting and raving make sure your argument makes sense or your just going to look more like a fool.

HAha, you still suck dick, regardless.
To answer your point, all my other pot head friends are the same. I believe all pot heads (IE everyday) are like this. I have yet to see a pot head to not fill this steriotype.
Yes, I know that not all people who smoke weed are pot heads.
My point is that employers should be alloud to discriminate and that the government shouldn't intervene, just like the government shouldn't intervene in drug use.
