ok i have this friend, well actually i just hired him so he is a employee,but anyways his roomate just got sent to prison for 5 years for supposedly touching his girlfriends daughter in places where a 36 year old man should not be touching a 11 year old girl,But the story i got from my friend is that the guy didnt do anything,that the girls real dad got her to make it all up in order to get him out of the picture,the guy took the 5 years because from what he says is because he is a convicted felon,he did 7 years for armed robbery when he was younger and said that he was looking at 25 years if he was found guilty,he didnt think his chances were good witha jury because of his record,so he pleaded out.......now i dont know about you,but i would sit in prison for the rest of my life fighting for my innocence before i would plead guilty to something i didnt do...expecially something like that what are your thoughts on this....was it smart to take the five instead of possibly getting 25,or would you(like me) refuse to do that and take your chances as a innocent man?

Spending even a year behind bars is hard to comprehend, I think. I totally see your point, but I don't know if I'd do it... All the more power to you, though, if you could tough it out. I don't think I could handle it.

You're assuming that he really is innocent. Of course, this friend of his would claim his innocence. And he definitely would want to claim it as well. I think odds are he did do it, and is trying to have some amount of a life to return to when he gets out.

I would -never- EVER -ever- take a plea on any sort of sexual assault. I would rather face 25 years depending on the jury's decision then a single day on a plea.

Not only are you a sexual predator, and marred for life as such. You cant live anywhere near a school, have anything to do with children, god forbid you reproduce. And your shame is publically broadcasted over several mediums. Even on a personal level, your honor is completely tattered.

You'd have better luck against a judge than a jury though. A jury is usually emotional and hates child molesters, whereas a judge will be able to realize it's the kid's word against the stepdads, and a good lawyer will get him off the hook.

If all the evidence they have is the kid's word, I'd suggest looking at an appeal. Appeal on the grounds that his council was incompetent previously, and he was not represented fairly, etc.

this has probably been said but i didnt read any of the post.
if the story is true, that guy has been in prison before, he is probably not desparate to get back, so rather than spending the rest of his youth in jail, he decided to go for the 5 year sentence. His track record is fucking horrible, if he really didn't do it, he should convince friends to prove his innocence then sue the shit out of that father, and compensate those who helped him get out of prison.

I would never want to do 5 years at all especially for something I didn't do. It may not sound like much when you say it but think about being locked up every single hour of the day 7 days a week for one thousand eight hundred and twenty five days. Fuck that, I would fight it.
