Yesterday, me and a few friends were about to toke up in a forest. Unluckily, there were cops in the area. After my friend lit his joint the cops came through the bushes. They saw we had a few smokes, and that my one friend had the joint. They said we were all in possession of marijuana, and searched us. I left my bag on the ground (which had 2 grams, a grinder with loose tobacco in it and a pack of zigzags). They confiscated all of this. Now the trick is, they had no grounds to search me and I gave them no permission to search my bag. The joint my friend lit up, I was unaware of and had no intention of smoking. I phoned the non-emergency line a while ago, and got the officers name and my file number. What I'm thinking of is contacting the arresting officer, and asking him questions about the incident (recording it aswell) to make the officer confirm my story. Since I live in Vancouver chances are they are not going to press charges. Could contacting the arresting officer about the case provoke him to charge me? Will I need a lawyer to do this? Will it have to go through court? And last, are there any chances I'll get my weed back?

Now when I do contact the officer, I plan on asking the following questions:
Did you see (myname) smoking a joint?
What were your grounds for searching (myname)?
Did (myname) give you verbal permission to search (mynames) bag?
Did you have a searchwarrent to search (mynames) bag?

What I'm afraid of is if he answers yes to me giving him verbal permission, which I did not. It would be my word against his, and my other friends who got caught there would certainly not be interested in testifying. Is there any other questions I can ask, or anything else to increase my chances?

People get illegal items back when they were searched illegally. Can they search u just because someone in your vicinity lit up a doob?

You can only recover items that aren't illegal to posses.

If they confiscated it without proper cause, it cannot be held against you in a court of law, and it is inadmissible as evidence.
But you will NEVER be returned an item which you cannot legally posses.

1 - Not sure about Canada but in most countries it doesn't matter if they search you illegally or not you're not getting you illegal items back. (You wont be charged with it if they searched you illegally but you sure as hell wont get the shit back)

2 - Yes him lighting up is enough for them to search you. Also as they were searching your items did you say "stop searching my stuff" if not then it was consensual.

Unless you have a medical card I would just forget about it. Even if you did I HIGHLY doubt they would give it back. Just let it go it's what can happen when you blaze in public places or even semi public. I live in Vancouver and no cops care if you blaze in your own house they just don't appreceaite you doing it outside infront of other people.
