Ok..I'll give you a jist of the story leading up to this.
I was shoplifting from Zellers, $54 worth of spraypaint to be exact, I was caught at the door by the LP and he handcuffed me(fuck up number 1) and I signed the papers saying I wouldn't come back for a year and he was about to let me go when they brought the buddy I was with into his office screaming and bloody in a chokehold fighting back so they phoned the police and we were both arrested and charged with theft under $5000.
Skip ahead..It's my fingerprinting date and I show up at the police station a few minutes earlier then it said on the slip and then I was informed I had a warrant and I was with my mom at the time and she asked them why I had a warrant and was going to jail, the cop responded that he didn't know and it was a really strange reason he had never seen before, I was then fingerprinted, got my mug shot and sent off to jail. Skip ahead 3 days I saw the judge and even the prosecutor was arguing why I was even in jail in the first place and the explanation they came up with was that the Crown Council had issued a warrant the morning I was supposed to come for fingerprinting because I was a youth at the time and they just presumed I wasn't going to show up later that day for my printing. So when I actually did show up on time like I was supposed to they didn't cancel the warrant and I was sent to jail for 3 days for no reason at all.
Skip ahead a few months...I'm still going to court for it and finally my lawyer files the papers saying I was wrongfully arrested and confined illegally and they realised they fucked up badddddddd and dropped my charges all together(  ) Now my lawyer wants to file a claim against Zellers for handcuffing me and the workers for tackling/choking my buddy and the LP for writing a false report(didn't match with the other employees statements) and filing a claim against the city for wrongful arrest and illegal confinment.
My question is should I really go ahead with it? Is my case strong enough to win?

I don't have a lot of experience with the law, so don't take my word over someone else who has more experience, but it sounds good to me. If not, just be happy you got off.

To sue that shop, that could be a bit of a stretch. But hell, I ain't your lawyer. If he/she thinks it can be done, then rock on!

If your lawyer sucks so much you prefer to trust TOTSE's community for this matter, you should change lawyer.
I don't think zellers could be sued... but the police station, maybe.
And maybe you should be nice to Zellers, THEY dropped their charges, If you sue them, they might get vindictive....

man, how much you paying that lawyer? thousands? or is it some legal-aid shit, or comission? if its something your not paying lots for, then go ahead, and screw the govt over. but remember, tis gonna take a lot of fighting for most likely. atleast another day in court, several hours of crap that lawyers charge. if its a usual rate they are charging, it can easily be 5 grand, without even winning. if you can get a lawyer on commission, no reason you shouldnt go for it. just watch you dont waste money, just for principle.
