Another "rape" question
So while discussing rape in my law studies class, an arguement started as to whether it's still rape if the girl (while about to get get raped) asks the rapist to wear a condom to prevent STD's/pregnancy, and the rapist goes with that.
So, by asking the rapist to wear a condom, would the sex still be considered rape?

That interesting. Would the offering of the condom be consent? I mean, it could definitely be forced sex, and they wouldnt' be able to say no, but it could probably be shown that giving him the condom was implied consent or something?
Personally, I think its a bit stupid. You can always take the morning after pill if you're worried about getting pregnant, and if the guy shoots off inside you, then you have his DNA. If he has a condom he can just take it and go and there goes your vindication.

I would say, yes, rape it be...
...a number of people who have been murdered, for instance, have begged their murderer to be quick about it.
However, before meeting their murderer, they were not seeking someone to kill them; furthermore, several of them started out begging for their life before the assault grew worse.
Ergo, it is murder, and not assisted suicide... and similarly, rape is rape, regardless of humanitarian pleas.
I'd consider wearing a condom on request a mitigating factor warranting a slight reduction in sentence over refusal, but not a plea of innocence.

Of course it's still rape. It's still nonconsensual--given a choice, I'm pretty damn sure the girl would pick no sex over forced sex with a condom--and therefore still rape by definition. It's just trying to reduce the impact in some way once they're resigned to the fact that they're going to be raped.

What about STD's? HIV? I think I'd rather just take it and be clean. The law's pretty messed up about convicting rapists anyway. Might as well try not ruin my life moreso.
