Child Abuse or justified?
SWIM got into a fight with his step-dad. Words were exchanged, then it ended with SWIM saying" Youd understand if you pull your head out of your ass" Well, that didnt sit too well with SWIM's step dad. It ended up with SWIM being slammed against a cupboard, while also simultaneously breaking a cabinet door. Then down against a counter top being held down and choked to where it was difficult breathing. Although he knows he shouldnt have said that, is what SWIM's stepfather did justified or not?

Not really. If SWIM's stepfather loses his temper to that extent, he should get help, whether or not it's child abuse - that just compounds the problem.

If all SWIM did was mouth off then yes it was over the top but unless SWIM is under the age of 16 or so it really isn't child abuse , more likely ABH/GBH.

Yeah, well... I ain't claiming that I seek to represent the man as an attorney, nor do I currently wish to act to represent myself as qualified to do so...

Hitting children is never justified. You have no recourse, he has no fear of being retaliated against. If I were you, I would blackmail him. Like, a full weeks pay or more. Remind him that it will be much more costly for him to go to court. In America, what your stepfather has done constitutes assault, and would even if you were an adult.

Step fathers should never physically harm a step child.
Its just not on.
To add to that, the actions the step father took are unacceptable even as a father if all that sparked it off was an argument.
Chocking someone is only one off killing them.
Is the guy an alcoholic or something?
Doe's SWIM have contact with his birth father?
Because if he gives a shit its likely he'll want to kill him.
I was in a similar situation, which was ended with me breaking cunts jaw.

SWIM's father is dead. SWIM didnt retaliate because he didnt want to escalate any more. SWIM cant take him to court because that is his houses only source of income SWIM's mother is out of a job and is searching for one right now. SWIM's step father is not an alcoholic or anything like that. SWIM knows he shouldnt of said that, but SWIM says it was more of a test then anything, because SWIM's step brother says the same things, or even ones that are worse, but never has he laid a hand on SWIM's step brother. And as SWIM predicted, it would be much worse for him. This isnt the first time something like this has happened to SWIM though.

I'm not a father, but I think that is completely out of line, especially as a step-father. As a parent in my opinion, you have to expect to be told some bad things once in a while and I do agree in punishment but not that kind of punishment. Especially as a step-father, doesnt he know that it is very hard for a kid to accept someone as their father who is not actually their real father? I think thats out of line completely.
EDIT- Based on your response, if you have contact with your real father or some adult you trust, you should honestly tell him. In my opinion, this guy deserves to have his ass kicked.

Close to the same happened to me, ages ago. Was about when I was 14, or so.
I was slammed into a wall repeatedly by my Dad, so hard that I had bruise marks on my back from the wall, and on my neck and shoulder from his fingers. I pushed him on the ground, and he got up and took a few swings at me, which I ducked and sidestepped. All this while swearing and yelling repeatedly at me. It ended when my sister stepped in the middle, crying.
Subsequently, I ran out of the house, and didn't talk to him for a year and a half after that. Didn't seem him for two and a half years. The first time I talked to him after that, he was on the edge of tears, and told me how much he was sorry and how he realizes that one night I lost all respect for one of the men I respected most in my life.
Nowadays, he refuses to yell or swear at anyone. He drinks half as much as he used to. I didn't have to fight him back, or call the police or anything. He learned by realizing that one stupid night nearly lost him his son.
So if your step dad has any respect for you, it's not too hard to make him realize what a brash situation that was.

I for one have never thought it made sense that your parents fucking own you. If you come down to it, its biological lottery, which is basically the same thing as divine right with different wording. Until their respective civil rights movements got them out of that status. I know young people who are way more intelligent and way more strong-willed than adults. The concept of "children being quiet and obedient to their elders" is such incredible bullshit.
