state seizure and forfeiture laws
i know this probably isn't the right section to post this question, but i was sure my fellow space travelers could help. i have been fighting the big boys for over a year trying to get my car back after their little combat mission on me. i could use any advise you may have since i am representing myself. let me say it is really pissing them off.

Re: state seizure and forfeiture laws
I think this is the wrong forum but....why not just pay the Tow company who hauled it away?? I don't know if that even had anything to do with your question. hahaha like I said, wrong forum.

Re: state seizure and forfeiture laws
some more information required;
was the vehicle crime derived?
was the vehicle crime used?
in what circumstances was it confiscated?
what illegal substances did you have in it?what criminals were in it?
what is your felony record?
what is your age?
once i have that, then thought can be put toward what measures can be used to reclaim your vehicle

Re: state seizure and forfeiture laws
The bad aspect of your problem is the enforcers(the law) has time on their side. The state attorney can stall your attorney till your monies are depleted and then you still don't have your vehicle back. With the
"Patriot Act" on the books and it is a crime
involving any drug activity, good luck. The
states are using this law to their advantage
just like the Feds are using it. You know the law can now incarcerate a person indefinitely without the person having right of council! And if this current administration has it's way, it will only get worse. Forget civil rights, a thing of the past. So if the law can hold you this way
what do you think they can do with your vehicle? Thank our congress for this stupid
blunder and our current attorney general and his cronies for this almighty power of attorney to do anything they damn well please
wthout a search warrant or any reason....
only if they suspect. Sounds like what happened in Germany in 1938! Oh yea, I just read you are representing yourself, unless
you are a 4th year law student or barrister
in training, you will need more than luck,
Princess, you will need a miracle or a honest
to God shaman. Dust in the wind
Pri

Re: state seizure and forfeiture laws
i just put this up in chemhead bill,,
seems relevant
--------------------------------------------------------------------------------
swim wants to have a real good bitch and moan about something..
As of now, a western democratic society has voted these acts and regulations into legislation;
the right to silence is taken as an admission of guilt
upon arrest, mandatory sample of urine for analysis to ascertain drug abuse
bail refused for serious drug offences
2year 8 month delay till trial(not legislation)
words fail me,explanation must suffice,,,,if your found not guilty of a crime,,,they can now re-arrest you and try you again if they can present more evidence,,dont ya love that one..
confiscation of all asstts,,no matter how obtained, upon conviction of a serious crime..
the insurance companies have removed all insurance because assetts have been confiscated and your a felonius risk.
worker compensation insurance is refused.
your unemployable.
as of jan 1st 2004,,all drug traffickers, and anyone classified as a drug trafficker upon conviction,,,,will have attached to his front door,a notice stating that this is the residence of a drug trafficker.
swim spoke quite heavily in a public forum in his home city,,on"why is it that crimes of robbing you, raping you, raping your children, are dealt with so lightly when taken against the small drug dealer who suffers a total ten year legal banishment from society".
this was to a meeting of young liberals,,swim tried to explain the shamefull propaganda put forward to criminilize drugs...
swim doubts his views were popular
theres gotta be something im missing here guys

Re: state seizure and forfeiture laws
no biggy lway
the car is nothing that great its the principle. there was nothing found in the vehicle or on my person. they have 90 days to file from the date seized, they waited until i filed a return of property(10 months later) and then the games began. around here nobody has the assets or wants the hassles no they plea thats why their conviction rate is so high and they can do as they please.
