| Network (in)Security Interesting hacks and cracks. Info on firewalls, TCP/IP, encryption, networks, and security. The ins and outs of the phone system, caller services, how things work, what's illegal and what's not, cellular phones, beepers, telephony legislation, the PUC, ISDN, taps, who's listening, and switches. Talking about phones, hacking systems, technical advice, and such is completely LEGAL in the United States -- it's covered by the First Amendment. What's illegal is conspiracy to commit a crime. So if you say something like "Meet me at 2am so we can crack a can" or "I changed my cell phone's number myself" you are criminally liable. Stating "You can crack a can by doing thus-and-so" or "If you wanted to change a cell phone's number, you could do it like so" is perfectly OK. Posting passwords, calling card numbers, or credit card numbers is forbidden on this network. Posting such info will get you booted off the net. |

Re: crack laws
but what law are you breaking?- from what i found it looks like the laws are state to state and it is a misdemeanor, maybe, BUT i cant find any law that says if you just access a computer/website and view it that it is illegal- i only find laws that say if you steal info or change info it is a crime but so far nothing on just looking through the system says it is illegal-- i'm not trying to justify anything nor will i crack into something just lookin' for the laws and have found nothing yet-- hmmm- 057

Re: crack laws
here we go
NEW YORK
ยง 156.10. Computer trespass
A person is guilty of computer trespass when he knowingly uses or causes to be used a computer or computer service without authorization and:
1. he does so with an intent to commit or attempt to commit or further the commission of any felony; or
2. he thereby knowingly gains access to computer material. Computer trespass is a class E felony.
*--notice the 'and:' which means you also have to commit the following to be charged-- so i found it is a class C misd. and only about 6 states have computer trespass laws- FOIA, totse iz tha shit--
opps, my bad -comp. trespass is a felony??? in NY if u commit the 'and:'?? but other states it appears to be a class C misd. 057

Re: crack laws
Thats kind of like some guy gong into your house while your at work. Walking around looking at things picking his nose.
Then when you get home he just says, sorry I was just testing your security.
He'd have to goto jail.

Re: crack laws
you know jack shit- shut up stupid-- B&E- physical break in is different than cybercrime idiot--that's like saying if i spy on someone with binoculars it is the same as B&E-- your retarded, try to breath under water-- my point, laws have not been written for simple cyber intrusion -- okay, crack FBI or national security database and your fucked but just snooping around your average site appears to be a misdemenor or not even a charge in some states yet-- 057

Re: crack laws
Read the Patriot Act.
http://www.keytlaw.com/netlaw/patriotact.htm#B.%20Subsection%201030(c)(2)(C)
All you need is intention to damage information... and trust me when I say this, it's very very easy for a judge to be convinced that you intended to damage information by trespassing into that computer.
This isn't petty State Law bullshit, this is Federal.
