Question reguarding legality...
Hi everyone, Ive got a question that Im hoping maybe someone here can answer: <p>

Lets say that theoretically I am making a website that performs an illegal service. Lets say, in this example, that it sells fake IDs. I know that if I were to have this site hosted by a webserver in the United states, I could probably be traced and arrested for this since it is not legal. However, what if I were to get my illegal site hosted by a webserver in, lets say, South Africa for example. Would my website now be subject to United States laws, since I actually live in the United States, or would it technically be "legal" since it is out of US jurisdiction? <p>

BTW, I am not actually making a fake ID service, so dont bother posting anything that specifically applies to fake ID sites, this is simply just an example

yes and no...
Its a hassle to arrest people running illegal site in dif countries. Your site might not get shut down, but if you are still mailing fake id's from the US your likely to get in trouble.
The government will tend to ignore you unless you start selling missile guidance systems.
Server in africa? hahaha... best to set up your own server on someone else's network.

It would be like selling drugs from South Africa. Fraudulent Identification is illegal in South Africa too. International drug distributors who sell to the US are busted as well, if not by the US then by South Africa, you see?

See anything odd here? Thank you for the replies guys, but try to read the origional post completely before replying. If you did, you would find that Im not really selling fake IDs, infact Im not selling anything at all. Also...

The reason the webserver would be in south africa in this case is because the website that I am running IS legal in South Africa...

Lets see, this is an odd situation if I can remember correctly. US residents looking at your site can be charged with the illegal activities even though the server is somewhere else. Gambling websites would be in a similar class as your own, figure out what they do. I'm not certain if what I said is fully correct.
