Default Watch what you post!

This is going into Bad Ideas, as is this is where it belongs.

As you've heard, I was served, etc.

But there was another thing to that (long story). In short, if I ever do that again I can be charged for a Terroristic Threat (which is a LEVEL 4 FELONY). I said something like "If we wanted to take over the school, it wouldn't be that hard.". Thing is, I NEVER SAID WE WOULD. So it's not a threat. It's more of a fact.

Anyways, yadda yadda yadda, you don't want to hear my shit. So, heres the real juicy post. Most of you won't have the attention span to read this, but, aw heck.

Watch What You Post!

--A document by VictorThree--

The regular Totse user, a calm, nice person that loves to help out and give advice about their "bad" side. They live a nice life, sitting on the computer 24/7 when they need to still get a job and move out of their mother's house.

But, as they don't know, the American government is constantly throwing bills that attack our freedom. That freedom is, the freedom of speech. The one and only, the freedom that allowed us to have this site. Bills released by congress attack us, making sure we cannot speak out unless spoken to.

So I'm here to advise you on how you post. Well, don't just sit there, get a peice of paper and right this down you silly baboon. The following tips below should make sure you do not fall into the same fate many others (including myself) have.

1. Keep everything hypothetical. EVERYTHING must be kept on a "what if we did...." basis.

2. NEVER say something like "I'm going to kill this guy...." or anything that would mean you are going to commit a crime. NEVER do this, as the feds can charge you for those few keys that you typed.

3. If insulting a person in particular, do NOT use their real name (first and last). You can make mentions towards them, or even post their first name, but never their full name.

4. Monitor your computer. Watch any accesses made onto it. There are many software programs that can do this for you. If you get a .edu scanning you, it is a school or part of the school system. A .gov scanning you can mean serious things, as thats a government tld. Be smart people.

5. Store your valuables (drugs, etc.) in a place where nobody except you knows. This will help you if a search warrant is issued on your ass.

6. Keep your cussing and insult words down to a minimum. This will help you if anyone presses charges.

7. When writing scams, ALWAYS put a disclaimer on them, stating it is for educational and entertaining purposes. Make sure that you will take no legal crap if somebody uses your info in the wrong way.

8. NEVER use the Totse name in anything (except posts resulting in something like "Totse rocks!" or "I'm leaving totse!"). Do not say things like "I'm gonna do this thanks to Totse". Be smart people, let some of us users keep this site.

9. DO NOT USE YOUR REAL NAME ON ANYTHING!!!!! I can't beleive you idiots that do this.

10. Use your god given mind. Be smart, and avoid trouble. This place is great, but doing some of these things can mean serious legal issues for you.

With all of that, your posts should be safe from any prosecution. Add to this, anything, just remember, always keep it hypothetical.

Protector of the innocent (haha)

Ragarding this thread:

As obvious, idea as it is to keep some posts hypothetical/theoretical, it still can not be stressed enough. This is archive material in my opinion. Sticky threads would be nice, as well as a preview button.

It sucks that you got hassled for bullshit like that. Welcome to America 2003, where people trade in freedom because of there fear and our politicians are happy to oblige. In case you haven't noticed it's people like us who end up having to foot the bill.

Here is my version of your list:

Don't Be a Fucking Idiot

--A document by Cross--<OL TYPE=1>

<LI>Instead of "I" when talking about past illegal experiences or plans use SWIM (or SWIC in my case), it means "someone who isn't me".

<LI>If you're stupid enough to talk about how you want to kill someone you should get off of this BBS and take some Zen yoga classes. It's about intelligent discussion not breaking the law and hurting people.

<LI>Never post real names, places or suppliers. No exceptions, if you really want to tell people then ask people to email you and reply to them with the information. If you do this then check your fucking email.

<LI>Get a firewall and use it. There are several good brands, be aware that the one that comes with Windows XP has built in back doors. Also Be sure to update it and auto update windows as well. Get a virus scanner as well, the government has been known to use keystroke loggers, seize your computer and use the information gathered by them in court. "Magic Lantern" I think it was called.

<LI>Don't have carbon copies of books like The Anarchist Cookbook, shit like that will do wonders for a jury's opinion of you and magically a PVC pipe can become "bomb making material".

As for drugs keep only what you need and if you tell people where you keep them you're an idiot, you'll get jacked by your "friends" (again I speak from experience) and the police will sure as hell find them.

<LI>Don't use obsessive swear words, I don't if it will hurt you if people press charges but too much swear words make you look like an idiot. Spellcheck your posts as well, check up on facts and if your not sure about them tell people that. It's a sign of mutual respect, that's why people get mad at you newbs when you don't. Learn to play the game.

<LI>A disclaimer really doesn't mean anything, they're easily dismissed in court. Though a disclaimer like this (http://www.sonic.net/~brucel/explosiveInjury4.html) (warning: gory) can save lives by getting people to think.

<LI>The media will always use &totse as a scapegoat whether its users do or not.

<LI>If you're stupid enough to give out your real name you deserve to get caught.

<LI>Don't do anything stupid. You are not bullet proof and there are a lot of people out there who's sole purpose of their job is to catch you breaking the law.

</OL>

Just there, that "do stuff" sentence. They can hold that as evidence and when you come to the country you will be arrested and prosecuted. Welcome to the land of the free!

But, yes, the US has ties with almost every other country, so you could probably be charged in your own country for that stuff.

As to me getting caught, a parent found the website where I had the movie and rant on, they gave it to the school, and the school took action. I'm going to ask my webhost for the access logs on that domain name. But you see, there were two things that everybody has so far overlooked. Firstly, there was a FRONT PAGE disclaimer, stating that by viewing this site you agree not to hold the owner responsible, yadda yadda yadda. Second off, the school principal DOWNLOADED the movies off of my website (I beleive via anonymous FTP, stupid me) and burned them to a disk. THIS goes against my copyrights, as I made the movie, and is a violation of Search/Seizure. My lawyer and I are going to argue that in court.

Oooo the land.... of theeeee freeeeee! And the home, of the, cynical.

And its amazing, in one of Eminem's songs, he bitches at America, also stating like "Fuck Mrs. Cheney" etc. And he got nothing because of it.

Freedom of speech ceases to exist. It's a damn shame.....

Its sounds like you, victor, have some seriously nosy people in your life.

These "concerned parent" types piss me off, the make a mountain out of nothing, and everybody goes along with it to protect their fucking kids. Kids don't need protection, they need freedom. Show them the right course, pick them up if they stray, and leave them the fuck alone otherwise. How else will they learn their lessons? Spoon fed by their mommy their whole life?

Secondly, everything said on this site should have a disclaimer implied. Everybody who knows about totse knows that when we say "threatening" things, they are not to be taken too seriously. This is a place to hang out and talk about things we'd never actually do, vent frustrations, and mainly talk theoretically on a lot of interesting topics too "taboo" for the regular world.

This is not a courtroom, this is not an interrogation, we are not under oath, and we have the right to say anything we want to say whenever we want to say it.

I would just like to add my two cents with this.

http://www.overgrow.com/edge/showthread.php?threadid=215109?s=cdcb57565e6385c49 8570f8be97aa674

quote:

Leo is hacking into here....

Is He? Probably. Does it much matter? Not really.

Throughout my presence here as legalistic blowhard I have seen the same concern popping up again and again. Is Overgrow safe? Can LEO get my IP? and so on...

Be assured that the DEA, RCMP and the various other agencies who care, have the time and money to hire some very intelligent people with almost infinite resouces when it comes to hacking and internet sleuthing in general. If they want your IP, with few exceptions, they will get it.

The big question that comes from the above is - "Does this put me at any kind of risk":?

Being used to covering my ass, I never want to say 100%, so will say that you are 99% safe even if they find out your ip and track you.

How can this be? Well, hacking is illegal. This is the starting point. Courts will not tolerate police doing illegal things to gain evidence to be used in a trial proper. The reason that you see cases thrown out of court for search violations is often due to defence lawyers attacking and quashing a warrant. However, if a cop taps your phone, searches your house or goes through your banking records with no warrant at all, then that is an even more egregious and illegal violation of basic rights and the evidence gained (and all subsequent evidence flowing from that) will never see the inside of a courtroom. To gain access to a server's records, so that they might be useful in any investigation or prosecution, will require a warrant. (I've got a funny feeling that should that happen here, we might hear about it.)

Ok, let's say the cops get a warrant somehow, (The possible grounds for the police to get a warrant for Overgrow in the first place are a mystery to me, I would love to hear some ideas) and take Overgrow's servers apart, finding all our IPs, then what? The police now have AN IP. Whose IP? Appparently someone, somewhere, who has access to that computer with that IP has been claiming that they grow marijuana. Which person? Is that person, who has been using that computer under an alias, reliable? Maybe it's a lot of bullshit boasting. And what about those pictures? Who do they belong to? Is it really that mysterious person's house, what house, the house with the ip / ISP registration or is the grow elsewhere?....See where I'm going here? Imagine if you were the cop showing up with a blank warrant before a judge - To Search: "mystery person" at "mystery location" for "fourth party, unconfirmed anonymous tip" - You'd feel pretty silly, wouldn't you? I expect the judge would look at you like you had three heads.

Remember in other threads were it was explained by both myself and our American legalists that anonymous tips are not enough for a warrant because the origin of the tip could not be established to be credible? The information on the Overgrow server is effectively an anonymous tip since the source of the information (an unknown entity behind a keyboard at a particular IP) cannot be established to be credible or even properly known. Even though the police may have magically gotten a warrant for Overgrow, they still have to get another warrant for you and there is no real possibility that they will get a warrant for YOU since they have no clue who YOU are or where your grow is.

There are also cross-jurisdictional issues here since this server is somewhere in Canada.

Now here's what the cops can do. Once they have gathered enough legitiamte evidence that you are growing (Smell, hydro bills, pictures of you carrying christmas tree sized plants out your door) then they will come in and, with a warrant, seize your computer and use whatever they find on it in your prosecution. But so what? By that point your fun is over anyway.

And before someone points it out, yes I'm aware (very aware) that police do illegal things all the time, my point is that it will not get them very far. You will have to have screwed up in the real world first.

Hack away LEO, we're watching.

Now that is for a site dedicated to marijuana cultivation. I dont really know if the same would apply to this place where dumbasses post things like "I wanna create a super virus to take over the world." Then again, much of the points in that apply.

CDG makes a very good point with that post written by Lothar on the Overgrow forums. If it was to long and you decided not to read it, I suggest you reconsider. But the problem is he latter made an ammendment to his post that goes as follows:

quote: Ok. I just had an email exchange with a Crown Attorney friend who works for the Department of Justice, Canada. (The feds who prosecute drug offences, although it does sound like a superhero thing.)

I was concerned that there might be a special provision to retreive server data without a regular warrant. From what we can tell, most of those special provisions only occur in a situation where the security of the country is in question. Terrorism, spying, that kind of thing would trigger special powers, but cultivation would apparently not.

The key word their being terrorism. A lot of the activities discussed here would be considered terrorism so we are not as safe as the users of Overgrow.com

If you know people with highly secure proxy chains and those people will let you use them, post whatever the fuck you want.

Either that, set a proxy up at work or school and patch your connection through it. I've done this and it works very well, plus you have the peace of mind that you're most likely the only one using it and it's unmonitored.

This is probably elementary to a lot of you. But if not, it may help, at least spark some curiousity and cause a realization that there is no need to live in fear. There are alternatives.

Otherwise, it would be wise to be careful.

Overgrow is also better off due to the fact that the servers are based in Canada. ~Shabang~ has also posted that he would rather destroy all of OG's data and logs than comply with a warrant to the information. Even if it means being criminally charged.

Following those rules is not enough. There are far too many to discuss. One could write many books only SKIMMING the surface of security and anonymity, and some have. There are far more things to secure your privacy than the tips you see on totse. Thats really dumb you got caught, and especially for something so stupid, but o well, you'll learn. Maybe you could email me the link to the vids? I'm curious to see what exactly it was. You must remember your consequences are not directly from a post; they are from real world actions. I don't even use a proxy on totse. I have no reason to, as I only do legal, moral things.

No, actually your wrong. You can be charged for the things you post.

The vids are no longer up, as it would piss the judge/family off even more if it was, but I can give you a brief description.

1. Stick figures (poorly drawn). I never spent enough time on it.

2. Poor animation. No walking, etc. I used Swish (a simpler version of flash).

3. Lame story. Yes, it was gay.

Yea, not much. But anyways, I'd like to comment on one thing.

You stated that you always do legal/legit stuff. If you do, then what the heck are you doing in bad ideas? I'm pretty sure most (if not all) of us have done something stupid.
