I didn't know where to post this, its somewhat of a Bad Ideas post (I did something stupid) and yet somewhat of a Spurious.
Anywho, moved or not, I'm going to be served tomorrow by the police. I've got a few questions on whats gonna happen.
1. I know I'm going to have to pay a fine. What I did was "disturbance of the peace". Any ideas on how much? (I'm in Nebraska)
2. Will they have a search/seizure warrant for my computer (as that was where the crime was commited, although the families decided not to press charges)?
3. What do I do? Basic actions, etc.?
4. Any ideas if community service will be involved?
5. I'm not going to invite the guy into my house and/or my room (I've got my chems (no drugs) and some other stuff).
6. ANY other thoughts would be nice. Don't post gay shit like "H4R H4R! Wh1p out j00r 9MM homie and shoot t3h motherfucker!", I don't respect people who post that stuff.
7. What is basicly going to happen? Will I need a lawyer?

I don't really know about the penalties, search for some law sites or something. Also, how do you know that you're going to be served? Can't you just not be there? They have to touch you with the papers or something like that, I doubt they go to a ton of trouble to find you for a nothing like this. Just a suggestion for the cowardly, probably better to just take it like a man.

I know I'm going to be served because the cops have already called my father.
I am a minor.
Chances are, I'm going to get a $50+ fine. Since the state cannot press charges, and the families have stated that their not, its just because I disturbed the peace. Not a huge deal, but I'm still worried. Any more ideas?

it cant hurt to format your hd but then again if the family isnt going to press charges then the cops dont have anything to prosecute you on do they....
oh yeah and i would do a reformat and def i mean def hide the chems and drugs or hide them at a friends house

FUCK reformatting. The police now can simply take your harddrive, plug it in, and retrieve data. The data recovery technolodgy they have are very advanced. At the least, use PGP to wipe your data first.

Yeah, you'd have to ditch the whole computer. However, I doubt whatever you did is that bad. If you're under 16, you're off the hook in terms of punishment. If you're between 16-18...I'm not sure. How about you ask a lawyer? Ask you're parents if they'll contact theirs...

i would, if at all possible, swap out the hard drive and send it on a vacation. i'm not sure if you got a family comp or not so this may not be an option. good luck. 420...

If we had the basic idea of what you did it might give us a better idea of how tough the judge'll be on you. You'll probably get community service, but if you ask me, that's a good thing. Instead of paying the local government more money that they'll squander on something stupid, you get to help some people out. Depending on the type of service, you might even get a good workout out of it.

True Kakkarun. 5-20 hours community service wouldn't be all that bad for me.
Is what I did was post flash movies that sexually portrayed a kid being gay from my school (anyone remember my "Animation Gets You Into Trouble Post?"). BUT I'm not being served for sexual harassment or anything like that, as far as I know I'm only going to be served with disturbance of the peace (Class 3 Misdeameanor). I've got a lawyer and all that.
I'm hoping a $50+ fine and a few hours of community service. If thats it, then I'll live with it.

Okay, how conservative is your town, and how large? This is one of the few instances where a conservative town might get you a /lighter/ sentence...

I dont really knw about nebraska laws but i did the same thing where i live. i had to pay a fine i think it was about $150-$200 but im not to sure. as for the search they did search me cuzz all i was doin was playin music but it depends on what u did. i sugest u save shit on a disk that u wnat and hide it then reformat ur hard drive and if the neighbors or whoeva complained didnt press charges it shouldnt be to serious

Ok. I was served, no warrant for my HDD was released, so I'm fine. Ther really won't be much evidence on this HDD anyways, as it was all done on the webhost.
ANYWAYS, I've got my court date which is set for September Ninth. I'm being charged with disturbance of the peace (in Nebraska, it's a class 3 misdemeanor). Nothing really huge.
I'm still nervous about court, but heck, I'll live. Life will continue on, but I'm still going to wipe my HDD with PGP and a data shreader, then format 5 or 6 times.
Thanks for your guy's help, damn, I'm gonna come to you for my problems :P

My friend does a lot of bad illegal stuff on his computer that could put him in prison for years. He has a kill switch on it that when he flips it his Harddrive will fry is sizzle. You should save everything to a couple of discs. Then mail them to a friend who lives a ways away. Then pull out your HD and hammer it to death. That is 'if' you think you will get in enough trouble for the material on your computer.

Yes cant escape the fine. You can possibly say your computer got hacked and the "virus" did these actions. Someone can control your computer from somehwere else if uv got a virus. Then do a format on your harddrive. If they assk why, say that the virus was always freezing your computer so u had to format.

Don't ditch your computer, but you'll have to do more than format the hard drive. There's free tools out there that let you retrieve something if you accidently delete it, even if it's past your recycling bin. To get everything off completely, you'll have to reset the hard drive to all zeros.

If they dont want your harddrive, I would still do a complete wipe with software designed for that specific purpose. After which, if you are smart about it you will reinstall windows and put most of your old programs on there. This would eliminate most suspicion, however the cops might check how recent your windows installation is. If they do check, it is very simple to claim you were hacked via the DCOM exploit which has been terrorizing all computers running NT, 2k, XP.
