If a police officer comes to my door because my neighbor claims they saw me smoking pot outside, do I have the right to now allow the police officer to enter my house?

I think the police themself would have to see you smoke the pot. They would need a warrent to search anything. And I doubt they could get a warrent from one person's accusings.

If you have a screendoor, make sure its locked and do not open it for him and only open your door just a crack, if you open the screen door or your door all the way then its like an open invitation for them to come inside your house.

i think they can come in. they now have probable cause that you are in posession of illegal substances. but if you say "im sorry officer i will need to see a warrant" then they will either have to go get one and come back, or they dont need one and you are in shit.

I've been lied to by the cops, and I've lied to them. Its just a common courtesy really. They usually don't want to be bothered with alot of paperwork. If you tell them you didn't touch anything or kill anyone, they usually(eventually) go about their way.

They can do anything they want, (and they often do) including shoot you through the head. All they have to do is simply report that you were uncooperative or belligerant or that you tried to push one of them, any simple lie and they are justified in doing whatever they want to do. They can say that you threatened to blow them away and reached for what they thought might be a gun, and Bang, you are dead.

By way of any of those frequently used lies they can say that you were 'Resisting Due Process of Law', which is a crime. It's their word against yours, and if you are arrested your personal testimony is no good as a witness. You are automatically the criminal and no jury will believe your testimony against theirs.

If you have alot of money and lawyers you may be able to protect yourself AFTER the fact, and have false charges dismissed, but it won't keep you from being falsely arrested and put in jail. In essence,you have no rights.

The Accused Has No Rights, No Ability to Defend Himself, Unless the Accused has a Substantial Amount of Money With Which to Post a Bail or Bond in Order to be Released from Incarceration and then to Secure Adequate Legal Counsel. The Court will appoint attorneys for poor people BUT THOSE appointed attorneys are grossly inneffective, PAID by the Government, so there is a Conflict of Interest. They are in fact working for the Government who is paying their fees. They will Not fight against, nor challenge in any significant way the System which is the hand that feeds them. Innocent people are imprisoned and guilty people go free on a daily basis in the USA.

The criminal justice system is completely corrupt, extremely inneficient and getting worse every day.

With respect to your specific question, if it were just that simple allegation alone, a patrol officer might come by to have a look, if they are not busy with some other complaint, and if you are sitting outside they are likely to question and harrass you. If you were inside, out of view they would probably not even stop, but they might.

If it happens to be a bad cop they might try to aggitate you and get you angry so they can pull some shit if you so much as say one thing back to them. That is what they usually do, especially in low income neighborhoods. If you so much as make one wrong facial expression they could just throw you on the ground and cuff you and take you to jail and write a simple report that you got out of line and they had to subdue you. They do in fact do this sort of thing all the time.

Now, a phone call where a neighbor suspects that you were smoking pot, is one thing- but snoopy neighbors have very big imaginations- they may imagine that anyone who comes to your house is a drug dealer, that you are a drug dealer, that any car they do not recognise, belongs to a drug dealer or is likely a stolen car etc., etc. Trust me on this, people who call the police frequently have real big imaginations that are fueled by Television and News media. Most Americans are very much out of touch with the true reality of their environment because they have so much fear and propaganda pumped into their homes by the Media. This really is true.

That's all I have to say about it except for this one thing that I have learned after many years of experience. AVOID THE POLICE as much as possible, and that includes not being in the wrong place at the wrong time, making sure that all of the lights and signals on your vehicle work, that you drive very well (btw, they can make up any lie in order to pull you over and harass you and they often do this- again mostly in poor neighborhoods and/or late at night).

Avoiding any encounters whatsoever with them is the best in my opinion.

You must be my lost twin brother I swear. Great post I wish everyone would take that advice. I agree, if they really want to, they can find some excuse to come inside. I just doubt that would happen in this situation, unless they've been looking for a reason to get in that particular house.

BC is the best weed growing location in the world and here everybody smokes pot. The cranky bitch next door ( i have one too) calls the cops on us all the time, when the cops show all we have to do is stand at the door and ask to see a warrant. They try to bargain and say you wont get in shit if you let him him blah blah . basically all we have to do is tell them to fuck off and we have our privacy simple as that. i dunno about the states or anywhere else but they cant come in unless they got papers.

Perhaps this is true at some higher levels of society/government, but if some cop comes to your door saying that your neighbour caught you smoking pot in your yard, you certainly have the right to tell the cop that your neighbour was mistaken.

Actually it's true, the reason they had the right to approach my car was that one of the passengers made a sudden jerky movement upon seeing the officer.

Oh yes, guilty til proven innocent is why I'm probably gonna spend the next 3 years in jail, it really is your word against theirs. When the police reports come through, you will see all kinds of things that you never really said on there.
