My girfriend (who is underage) sent me a naked pic to me(who is also underage) is that considered kiddie porn? and could i get in trouble if that happened? even though it hasn't happened she wants to send me a pic but i won't let her

i recently heard of a case where kiddie porn isnt illegal unless its in print, so on your comouter it could be fine. Although the kiddie porn was "art" and they had the consent of the parents.

kiddie porn isnt limited to hardcopy [paper etc] format.

now, as far as prosecution: yes and no. they sure as hell would, if they could catch such a thing which i strongly doubt, charge you. they might even fuck with your parents over it. but, given your age, i doubt very seriously unless you cracked, that they could actually make anything stick. i just dont see a jury convicting.

but this is saying youre caught in the first place, which considering the one time thing, i cant see happening.

I heard from somewhere that you can get charged with child pornography if you distribute pornographic pictures of yourself if you're underage. Any validity to that?

D Krunk, yes. You can get prosecuted for distributing sexual pictures of yourself if you're underage.

On topic though... I don't think so. So long as it stays on your computer, and doesn't get published on a website, you should be fine.

Before you take the advice of those saying not to worry about it realize this; That image will likely go through several servers before it gets to it's destination. Think encryption if you're serious. Beyond that, yeah it's still a longshot any of those servers would single out your file in the millions that run through their machines.

No matter what form they are in, having pornographic images of minors is illegal. Considering you are a minor and the circumstances involved you will probably just get a slap on the wrist- if you are caught.

This guy is paranoid. I know many people who have done it. Unless your girlfriend is 5, they probably won't be able to tell how old she is, and they have enough crap to wade through that even if they did know, they wouldn't care (assuming it's only a couple pictures and you were the only one who saw them).

Juvenile court doesn't have a jury, just a judge, a case handler, your laywer and the DA, but you are right, I'd say send the pic, god only knows how many underage girls go on their webcams for their boyfriends or what not, I really don't think anyone is going to care(except maybe her or both of your parents) if your caught with them, I don't think any judge is going to fry you and your future for getting nude pics of your girlfriend.

Steph, no I'm not paranoid. I'm giving this guy facts. People generally think they post something from their computer and it goes from their computer to the receiving computer. It doesn't work that way. Depending on their ISP it will probably be routed through many servers before it gets to its destination, each server having a "copy" in it's cache of what was sent. That's how transferring of files works.

Ask in the forum apportioned to this here on totse, Technophiles, they'll tell you the same.

You know I have heard somewhere that it's not illegal unless they are in a sexually explicit pose. Then again I'm not entirely sure where I heard that from, so I wouldn't trust it. But if it helps your choice go ahead and believe... unless your chick is gonna send you a nasty pic...
