statutory rape?
I've been searching all over the internet and I can't find a specific answer to this question. I live in California and I have a girlfriend who is 17 (she'll be 18 this year) and I am 19 (we are 1 year and 1 month apart). We are considering persuing sexual activities. It seems that her parents are cool with it, and of course she is, but I believe it is still illegal. As far as i can gather it is a misdemeanor becasue we are less than 3 years apart. Does anyone know the penalities for this "crime"?

I'm not a lawyer either, but I know these things about statutory rape laws:
1. NOONE (repeat, NOONE!!!!!) can give consent for you to have sex with her now.....PERIOD!!! That means, her Mama can't give consent; her Papa can't goive consent; and the girl, herself, can't give consent!! THERE ARE NO EXCEPTIONS!! So, sorry to have to tell you this, but if you have sex with her, YOU WILL HAVE COMMITTED A CRIME.
It's true, of course, that someone will have to "report" you before you get arrested. And, even though you say Mama, Papa, and the girl are all gung-ho for this right now, THINGS CAN CHANGE IN THE FUTURE!! If you rely on their "consent" right now, YOU WILL HAVE GIVEN THEM THE POWER TO PUT YOU IN JAIL IN THE FUTURE. Right now, there are lots of "legal girls" for you to enjoy, and, and prison will be a sorry, girl-free kind of place for you if you end up there!!
I hope you don't give this girl or her parents even the potential power to take away your freedom.......'cause that is likely to happen if there is some kind of "falling out" of favor with you in the future!! THATS' A LOT OF POWER OVER YOUR LIFE TO GIVE AWAY TO SOMEONE ELSE!!

The laws are fucked up... if you and your gf are on good terms, and the parents are cool, my advice is quote "fuck the law".. end quote...
You at 19 and her at almost 18... give me a fucking break... you two deserve to not be fucked with, however, the law is the law... all things considered, be careful and protect yourself. Flying under the radar is your best option, don't get caught in other words. It makes me sick that society has the power to impose "rules" on consensual activities period. Be aware of the consequences of your actions but be true to your feelings (with discrection) first, and have a good time...

I AGREE....the law is f__cked up!! BUT I just don't want to see a nice guy going to jail because of some now warm and inviting 17 year old twit who gets mad at him later and has him put in jail!! Thanks for all the replies guys, all good advice. I think i need to sit back for a while and really think about it, is it worth it? Maybe not. As far as i can tell i wouldn't be going to jail, but i would have to pay $2,000 which really sucks, considering we are so close in ages. Stupid law i think.

Actually, it doesn't really matter a lot, unless you videotape the fucking then she'll never have any proof of it and without proof you can't be convicted of anything. Especially true if you've just broken-up with her as she has a motive for getting you in jail.

There are too many damn laws in this fucked up country(usa)...My best advice to anyone is to break as many as you can then move to a better country.(which is what i plan on doing a year from now)

I'd like to shed some light on this topic. In my state, at least, you only have to be within two years of each other and it's legal. So someone that is 18 can legally fuck a 16 year old. That means you would be safe.

a couple of loopholes i might have found in Easys post:
1: It only says intercourse. Now i don't know how this translates to judges and shit, but to me, it says you can't fuck her. I'd personally be just fine with bjs for a year.
2: It says the fine won't exceed 2000 bucks. since your just above and just below the age, i think they'd give you a big break of that IF you get caught by people who give a shit, which I think your smart enough to not do.
mmkay, thats my input. I say go for it. If her parents are chill with it, anyone who catches you prolly won't exactly check IDs to see if your underaged or not. Just don't like fuck in public, and don't piss her off.

My cousin was 18 and his girlfriend was 17 they were 6 months apart. They got into a fight and her father WHO KNEW they were haveing sex pressed charges. My cousin went to jail for a year and has to register as a sex offender which includes sending a letter to his neighbors and posting a sign on his house that he is a registered sex offender for the rest of his life. Every time he moves his name gets put in the paper of where he moved to.
Check the laws very closely even if that means asking a lawyer about it- they give free consultations for the first visit.

^^Criminal defense lawyers give you NOTHING for free, and the "free consultation" is just a sales pitch, which they give you once you've been charged. Pardon the tone, but there's a whole lotta misinformation out there about what attorneys will and won't do.
Anyways, I honestly think the statutory rape issues are often blown out of proportion. If you're a decent person with an honest life and no related priors, it would be quite unlikely that a DA in any county would pursue this.

but if we are both minors and the separation of age is about 1 year and 9 months, then its not a problem. but there will be a period of 1.75 years where it would be illegal
but the law doesnt seem to be held to high at totse. thats why i stay around
